AN ACT
SB 456
Relating to students; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION
1. (1) A kindergarten through
grade 12 public school administrator, teacher, counselor or nurse may not
recommend to a parent or legal guardian of a student that the student seek a
prescription for a medication that is prescribed with the intent of affecting
or altering the thought processes, mood or behavior of the student.
(2)
Nothing in this section:
(a)
Prohibits a kindergarten through grade 12 public school administrator, teacher,
counselor or nurse from communicating with a parent or legal guardian of a
student concerning the behavior of the student at school; or
(b) Relieves a school district of the duty to identify, locate and evaluate students with disabilities.
SECTION 2. Section 1 of this 2003 Act first applies to the 2003-2004 school year.
SECTION 3. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect on its passage.
