AN ACT
SB 287
Relating to school food programs; appropriating money; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION
1. (1) During the 2003-2005
biennium, the Department of Education may reimburse school districts and
community groups that have summer food service programs that serve an
attendance area for a school in which 85 percent or more of the students
enrolled at the school are eligible for free and reduced price meals under the
United States Department of Agriculture’s current Income Eligibility
Guidelines.
(2) The State Board of Education may adopt any rules necessary for the administration of this section.
SECTION
2. (1) The requirements of this
section apply only to local commissions on children and families located in a
county that includes an attendance area for a school in which 70 percent or
more of the students enrolled at the school are eligible for free and reduced
price meals under the United States Department of Agriculture’s current Income
Eligibility Guidelines.
(2) Prior to June 1, 2004, each local commission on children and families shall place on the agenda of at least one meeting of the local commission a discussion of the coordination and provision of summer food service programs to children. Each school district that is within the attendance area served by the local commission and that has a school with a student population in which 70 percent or more of the students enrolled at the school are eligible for free and reduced price meals shall have a representative of the school district at the meeting.
SECTION
3. (1) During the 2003-2005
biennium, the Department of Education shall convene an advisory group to study
summer food service programs. The Superintendent of Public Instruction shall
appoint the members of the advisory group.
(2)
The advisory group shall make recommendations regarding:
(a)
How to make summer food service programs more cost effective;
(b)
Whether to expand the program described in section 1 of this 2003 Act and offer
summer food service programs to students who attend schools in which 70 percent
or more of the students enrolled at the school are eligible for free and
reduced price meals under the United States Department of Agriculture’s current
Income Eligibility Guidelines; and
(c)
Whether to increase the appropriation amount specified for the 2003-2005
biennium in section 5 of this 2003 Act for the 2005-2007 biennium and whether
to ask the Seventy-third Legislative Assembly for that appropriation.
(3) The department shall submit a report on the study and recommendations of the advisory group to the interim committees on education, in the manner provided by ORS 192.245, no later than October 1, 2004.
SECTION 4. Sections 1 to 3 of this 2003 Act are repealed on July 1, 2005.
SECTION 5. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Education, for the biennium beginning July 1, 2003, out of the General Fund, the amount of $49,000, which shall be expended for reimbursements for summer food service programs pursuant to section 1 of this 2003 Act.
SECTION 6. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
