Chapter 607 Oregon Laws 2003

 

AN ACT

 

HB 5020

 

Relating to the financial administration of the State Department of Fish and Wildlife; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There is appropriated to the State Department of Fish and Wildlife, for the biennium beginning July 1, 2003, out of the General Fund, the following amounts for the following purposes:

 

      (1)    Wildlife Division:

      (a)    Wildlife game...........................   $    329,661

      (b)    Wildlife habitat........................   $    152,764

      (c)    Wildlife diversity.....................   $    753,199

      (2)    Fish Division:

      (a)    Fish propagation......................   $ 5,746,974

      (b)    Fish natural production...........   $    535,930

      (c)    Fish marine resources.............   $ 1,292,465

      (d)    Fish interjurisdictional

              fisheries...................................   $ 1,033,062

      (3)    Administrative Division..........   $    904,427

      (4)    Capital improvement...............   $    203,859

 

          SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the State Department of Fish and Wildlife for the following purposes:

 

      (1)    Wildlife Division:

      (a)    Wildlife game...........................   $ 20,889,467

      (b)    Wildlife habitat........................   $ 4,858,746

      (c)    Wildlife diversity.....................   $    328,198

      (2)    Fish Division:

      (a)    Fish propagation......................   $ 7,690,372

      (b)    Fish natural production...........   $ 20,369,687

      (c)    Fish marine resources.............   $ 3,696,525

      (d)    Fish interjurisdictional

              fisheries...................................   $ 6,374,808

      (3)    Administrative Division..........   $ 30,847,914

      (4)    Capital improvement...............   $ 6,217,372

      (5)    State Police enforcement

              contract....................................   $ 12,265,670

 

          SECTION 3. Notwithstanding any other law limiting expenditures, the amount of $10,401,200 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from lottery moneys allocated from the Parks and Natural Resources Fund to the State Department of Fish and Wildlife, for activities and projects to implement section 4 (10), Article XV of the Oregon Constitution.

 

          SECTION 4. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from federal funds collected or received by the State Department of Fish and Wildlife for the following purposes:

 

      (1)    Wildlife Division:

      (a)    Wildlife game...........................   $ 2,217,262

      (b)    Wildlife habitat........................   $ 12,707,120

      (c)    Wildlife diversity.....................   $ 3,136,431

      (2)    Fish Division:

      (a)    Fish propagation......................   $ 31,533,186

      (b)    Fish natural production...........   $ 28,867,264

      (c)    Fish marine resources.............   $ 5,278,840

      (d)    Fish interjurisdictional

              fisheries...................................   $ 8,703,062

      (3)    Administrative Division..........   $ 1,284,722

      (4)    Capital improvement...............   $ 3,256,006

 

          SECTION 5. For the biennium beginning July 1, 2003, expenditures for debt service on Certificates of Participation are not limited.

 

          SECTION 6. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
