Relating to withdrawal of territory from district.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. Section 2 of this 2003 Act is added to and made a part of ORS 267.510 to 267.650.

 

          SECTION 2. (1) Notwithstanding the limitations under ORS 198.870 on withdrawal from a district, if all or part of a city with a population of fewer than 10,000 individuals is located within the territorial boundaries of a transportation district in southwestern Oregon, but does not receive regularly scheduled direct transportation services from the district, the governing body of the city may petition the governing body of the district for a resolution approving the withdrawal from the district of the part of the city that does not receive regularly scheduled direct transportation services.

          (2) The governing body of the district and the governing body of any affected county shall approve a petition for withdrawal under this section.

          (3) As used in this section, “southwestern Oregon” means that portion of the State of Oregon located south of the City of Roseburg, west of the summit of the Cascade Range, north of the southern boundary of the state and east of the Pacific Ocean.

 

          SECTION 3. Section 2 of this 2003 Act is repealed January 2, 2006.
