Chapter 635 Oregon Laws 2003
AN ACT
HB 5048
Relating to the financial administration of the Public Defense Services Commission; appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. There are appropriated to the Public Defense Services Commission, for the biennium beginning July 1, 2003, out of the General Fund, the following amounts for the following purposes:
(1) Public Defense Direct
Services................................... $ 5,257,081
(2) Public Defense Contract
Services................................... $ 153,694,576
(3) Public Defense Adminis-
tration....................................... $ 2,669,816
SECTION 2. Notwithstanding any other law limiting expenditures, the amount of $1,135,852 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Public Defense Services Commission, for the Public Defense Administration.
SECTION
3. (1) In addition to and not in
lieu of any other appropriation, there is appropriated to the Emergency Board,
for the biennium beginning July 1, 2003, out of the General Fund, the amount of
$7 million, for allocation to the Public Defense Services Commission for public
defense contract services workload growth.
(2) If all of the moneys referred to in subsection (1) of this section are not allocated by the Emergency Board prior to December 1, 2004, the unallocated moneys on that date become available for any other purpose for which the Emergency Board lawfully may allocate funds.
SECTION 4. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
