Chapter 666 Oregon Laws 2003

 

AN ACT

 

HB 5045

 

Relating to the financial administration of the Department of State Police; appropriating money; limiting expenditures; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. There are appropriated to the Department of State Police, for the biennium beginning July 1, 2003, out of the General Fund, the following amounts for the following purposes:

 

      (1)    Patrol services, criminal

              investigations and gaming

              enforcement.................................     $  89,706,944

      (2)    Fish and wildlife enforcement.....     $    3,844,135

      (3)    Forensic services and

              State Medical Examiner.............     $  23,539,977

      (4)    Human resources, office

              of information management

              and criminal justice services.......     $  44,072,756

      (5)    Office of Emergency

              Management...............................     $    1,706,438

      (6)    Debt service................................     $       969,566

 

          SECTION 2. Notwithstanding any other law limiting expenditures, there are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds, collected or received by the Department of State Police, the following amounts for the following purposes:

 

      (1)    Patrol services, criminal

              investigations and gaming

              enforcement.................................     $  22,058,331

      (2)    Fish and wildlife enforcement.....     $  14,568,230

      (3)    Forensic services and

              State Medical Examiner.............     $    3,655,297

      (4)    Human resources, office

              of information management

              and criminal justice services.......     $  10,781,573

      (5)    Office of Emergency

              Management...............................     $  63,912,830

      (6)    State Fire Marshal .....................     $  14,742,891

 

      SECTION 3. Notwithstanding any other law limiting expenditures, there are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from federal funds collected or received by the Department of State Police, the following amounts for the following purposes:

 

      (1)    Patrol services, criminal

              investigations and gaming

              enforcement.................................     $    5,117,348

      (2)    Fish and wildlife enforcement.....     $       526,455

      (3)    Human resources, office

              of information management

              and criminal justice services.......     $  78,052,806

      (4)    Office of Emergency

              Management...............................     $    7,765,027

      (5)    State Fire Marshal......................     $       452,916

 

          SECTION 4. For the biennium beginning July 1, 2003, expenditures for payments to cities and counties for federal emergency management assistance from funds from the United States Department of Homeland Security are not limited.

 

          SECTION 5. Notwithstanding any other law limiting expenditures, and notwithstanding ORS 541.377 (7), the amount of $5,737,615 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses of the Department of State Police for fish and wildlife enforcement activities from moneys or other revenues allocated to the Parks and Natural Resources Fund from lottery funds made available under section 4 (10), Article XV of the Oregon Constitution.

 

          SECTION 6. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
