AN ACT
HB 5022
Relating to the financial administration of the State Forestry Department; appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. There are appropriated to the State Forestry Department, for the biennium beginning July 1, 2003, out of the General Fund, the following amounts for the following purposes:
(1) Agency administration............ $ 7,331,347
(2) Protection from fire................. $ 20,264,358
(3) Forestry assistance................. $ 857,892
(4) Forest practices....................... $ 4,065,554
(5) Debt service............................ $ 2,041,933
SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, excluding lottery funds, but including federal funds from the United States Forest Service for fire protection and for research projects, collected or received by the State Forestry Department, for the following purposes:
(1) Agency administration............ $ 8,869,065
(2) Protection from fire................. $ 53,363,655
(3) State-owned forest lands......... $ 58,809,482
(4) Forestry assistance................. $ 3,437,801
(5) Forest practices....................... $ 10,663,135
(6) Capital improvement............... $ 3,791,463
(7) Debt service............................ $ 1,243,555
(8) Forest nursery......................... $ 4,676,665
(9) Equipment pool........................ $ 13,166,321
(10) Facilities maintenance
and
development..................... $ 3,315,148
SECTION 3. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from federal funds collected or received by the State Forestry Department for the following purposes:
(1) Agency administration............ $ 692,994
(2) Protection from fire................. $ 12,558,742
(3) State-owned forest lands......... $ 137,440
(4) Forestry assistance................. $ 5,350,218
(5) Forest practices....................... $ 305,129
SECTION 4. For the biennium beginning July 1, 2003, expenditures for the equalization of emergency fire suppression costs from the Oregon Forest Land Protection Fund, for the purchase of insurance referred to in ORS 477.775 or for fire cost claims are not limited.
SECTION
5. (1) In addition to and not in
lieu of any other appropriation, there is appropriated to the Emergency Board,
for the biennium beginning July 1, 2003, out of the General Fund, the amount of
$5,700,000, for allocation to the State Forestry Department for fire protection
expenses.
(2) If any of the moneys referred to in subsection (1) of this section are not allocated by the Emergency Board prior to January 1, 2005, the unallocated moneys on that date become available for any other purpose for which the Emergency Board lawfully may allocate funds.
SECTION 6. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
