AN ACT

Relating to the financial administration of the State Department of Agriculture; and declaring an emergency.
Be It Enacted by the People of the State of
SECTION 1. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following new or increased fees, adopted by the State Department of Agriculture and approved by the Oregon Department of Administrative Services, are approved:
(1) Voluntary fee for service
paid for certification of

(2) Annual pesticide
registration fee........................ $ 160

(3) Annual registration fee for
fertilizer, agricultural mineral,
agricultural amendment or
lime products........................... $ 25

manufacturer/bulk distributor
of fertilizer, agricultural
mineral, agricultural
amendment or lime products
(per licensed
business).................................. $ 50
(5) Initial product evaluation
fee for fertilizer,
agricultural mineral,
agricultural amendment
or lime products....................... $ 50
per product
(6) Fee for reregistration of or
reevaluation of registration
for fertilizer, agricultural
mineral, agricultural amendment
or lime products....................... $ 50
per product
(7) Annual license fee for
liquefied petroleum gas
vapor-measuring devices:
(a) 1" pipe diameter or under....... $ 15
(b) Over 1" pipe diameter............ $ 20
(8) Annual fees for European
pine shoot moth surveys......... $ 85 per location
SECTION 2. For the purpose of carrying out the provisions of ORS 291.055 (1)(e), the following new or increased fees, adopted by the State Department of Agriculture and approved by the Oregon Department of Administrative Services, are approved:
(1) Brand inspection fee for horses
at licensed auction sales
and slaughter plants................ $ 3.75
per head
(2) Fee for cattle transportation
certificates............................... $ 1.50
per book
(3) Annual license fee for nursery growers,
other than greenhouse growers of
herbaceous plants, and for collectors
of native plants:
(a) Annual sales up to $20,000..... $ 100
(b) $20,001 - $100,000 ................. $ 100 plus .0031 over $20,000
(c) $100,001 - $200,000................ $ 348 plus .0029 over $100,000
(d) $200,001 - $500,000................ $ 638 plus .0023 over $200,000
(e) $500,001 - $2,000,000............. $ 1,328 plus .0014 over $500,000
(f) $2,000,001 or more ................. $ 3,428 plus .0004 over $2,000,000
(g) Maximum fee is $20,000
(4) Annual license fee for greenhouse
growers of herbaceous plants:
(a) Annual sales up to $20,000..... $ 100
(b) $20,001 - $100,000 ................. $ 100 plus .00125 over $20,000
(c) $100,001 - $200,000................ $ 200 plus .001 over $100,000
(d) $200,001 - $500,000................ $ 300 plus .0005 over $200,000
(e) $500,001 - $2,000,000............. $ 450 plus .00025 over $500,000
(f) $2,000,001 or more.................. $ 825 plus .0004 over $2,000,000
(g) Maximum fee is $20,000
(5) Annual license fee for dealers,
florists and landscape contractors:
(a) Annual sales up to $20,000..... $ 100
(b) $20,001 - $100,000.................. $ 100 plus .00125 over $20,000
(c) $100,001 - $200,000................ $ 200 plus .001 over $100,000
(d) $200,001 - $500,000................ $ 300 plus .0005 over $200,000

(f) $2,000,001 or more ................. $ 825 plus .0004 over $2,000,000
(g) Maximum fee is $20,000
(6) Fee paid by licensed nursery or
Christmas
tree grower for issuance of
phytosanitary and other certificates,
on any given day:
(a) First certificate issued
during billing period................. $ 20
(b) Each additional certificate
after first certificate................ $ 10
(7) Fee paid by persons not required
to be licensed, for issuance of
Phytosanitary
and other certificates,
on any given day...................... $ 60
per hour ($30 minimum)
(8) Fees for laboratory or other testing
services, including sample processing,
analysis and issuance of certificates or
official reports......................... $ 70
per hour ($35 minimum)
(9) Fees for specific routine
laboratory tests:
(a) Spore wash and microscopic
examination, per fungal
species..................................... $ 50
(b) Fifty-seed stain and microscopic
examination for endophyte..... $ 85
(c) Seed, soil or tissue test
for nematodes.......................... $ 35
(d) Visual exam for regulated
pests......................................... $ 50
(e) Visual exam for regulated

(f) Isolation on standard
media........................................ $ 35
(g) Growing media pH and

SECTION 3. This
2003 Act being necessary for the immediate preservation of the public peace,
health and safety, an emergency is declared to exist, and this 2003 Act takes
effect
