Relating to state financial administration; creating new provisions; amending section 3, chapter 13, Oregon Laws 2002 (third special session), section 7, chapter 9, Oregon Laws 2003 (Enrolled Senate Bill 5548), and sections 15, 20, 21, 22 and 25, chapter 732, Oregon Laws 2003 (Enrolled House Bill 5067); appropriating money; limiting expenditures; and declaring an emergency.

SECTION 1. (1)

SECTION 5. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Higher Education, for the biennium beginning July 1, 2003, out of the General Fund, the amount of $100,000 for payment of administrative expenses of the Oregon Council for Knowledge and Economic Development.
SECTION 6. In
addition to and not in lieu of any other appropriation, there is appropriated to

Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 2, chapter 665, Oregon Laws 2003 (Enrolled Senate Bill 5525), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Justice, is increased by $964,581.
SECTION 8. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 2 (1), chapter 666, Oregon Laws 2003 (Enrolled House Bill 5045), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds, collected or received by the Department of State Police, is increased by $1,050,345.
SECTION 9. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 2, chapter 586, Oregon Laws 2003 (Enrolled Senate Bill 5531), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Long Term Care Ombudsman, is decreased by $24,268.
SECTION 10. Notwithstanding any other law appropriating moneys, the appropriation out of the General Fund for the Judicial Department, established by section 1 (1), chapter 717, Oregon Laws 2003 (Enrolled Senate Bill 5523), for the biennium beginning July 1, 2003, is decreased by $6,600,000.
SECTION 11. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 2, chapter 717, Oregon Laws 2003 (Enrolled Senate Bill 5523), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Judicial Department, is increased by $6,600,000.
SECTION 12. Notwithstanding any other law appropriating moneys, the appropriation out of the General Fund for the Oregon Youth Authority, established by section 1 (1), chapter 634, Oregon Laws 2003 (Enrolled House Bill 5058), for the biennium beginning July 1, 2003, is decreased by $600,411.
SECTION 13. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 3, chapter 634, Oregon Laws 2003 (Enrolled House Bill 5058), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from federal funds, collected or received by the Oregon Youth Authority, is increased by $600,411.
SECTION 14. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 1 (1), chapter 651, Oregon Laws 2003 (Enrolled House Bill 5049), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Public Safety Standards and Training, is increased by $339,690.
SECTION 15. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 2 (2), chapter 490, Oregon Laws 2003 (Enrolled Senate Bill 5536), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from lottery funds allocated to the State Parks and Recreation Department is increased by $3,000,000.
SECTION 16. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 2 (3), chapter 490, Oregon Laws 2003 (Enrolled Senate Bill 5536), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from lottery funds allocated to the State Parks and Recreation Department is increased by $3,000,000.
SECTION 17. Notwithstanding any other law limiting expenditures, the amount of $173,648 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Commission on Asian Affairs.
SECTION 18. Notwithstanding any other law limiting expenditures, the amount of $171,969 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Commission on Black Affairs.
SECTION 19. Notwithstanding any other law limiting expenditures, the amount of $224,441 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Commission on Hispanic Affairs.
SECTION 20. Notwithstanding any other law limiting expenditures, the amount of $1,136,003 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Commission for Women.
SECTION 21. In addition to and not in lieu of any other appropriation, there is appropriated to the Oregon Department of Administrative Services, for the biennium beginning July 1, 2003, out of the General Fund, the amount of $22,000, which may be expended for expenses related to unemployment compensation, accrued paid vacation leave and other obligations of the Commission on Asian Affairs, the Commission on Black Affairs, the Commission on Hispanic Affairs and the Commission for Women.

addition to and not in lieu of any other appropriation, there is appropriated

SECTION 25. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 49 (1) of this 2003 Act, for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Higher Education, is increased by $5,000,000.
SECTION 26. Notwithstanding any other law limiting expenditures, the limitation on expenditures established for the biennium beginning July 1, 2003, by section 2, chapter 584, Oregon Laws 2003 (Enrolled Senate Bill 5518), as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, and including federal funds from the Reed Act (42 U.S.C. 1103), collected or received by the Employment Department, is decreased by $20,500,000.
SECTION 27. Notwithstanding any other law, the appropriation to the Employment Department out of the funds made available to this state on March 13, 2002, under section 903(d) of the Social Security Act (42 U.S.C. 1103(d), as amended), established by section 3, chapter 584, Oregon Laws 2003 (Enrolled Senate Bill 5518), for the biennium beginning July 1, 2003, in increased by $20,500,000.
SECTION 28. Notwithstanding any other law limiting expenditures, the limitation on expenditures established by section 1 (3), chapter 439, Oregon Laws 2003 (Enrolled Senate Bill 5538), for other administrative expenses, established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Public Employees Retirement System, is increased by $7,445,895.
SECTION 29. If
House Bill 2020 becomes law, notwithstanding any other law limiting
expenditures, the following amounts are established for the biennium beginning
July 1, 2003, as the maximum limits for payment of expenses from fees, moneys
or other revenues, including Miscellaneous Receipts, but excluding lottery funds
and federal funds, collected or received by the Public Employees Retirement
System to implement the Oregon Retirement Plan established by section 2,
chapter 733, Oregon Laws 2003 (Enrolled House Bill 2020):

Operational and administrative expenses, $1.
(2)
Payment of costs of issuance of financing agreements issued under ORS 283.087,
$1.
(3) Payment of principal and interest on financing agreements issued under ORS 283.087, $1.
STATE SCHOOL FUND
SECTION 30. In
addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Education, out of the General Fund, for the fiscal year
beginning

addition to and not in lieu of any other appropriation, there is appropriated
to the Department of Education, out of the General Fund, for the fiscal year
beginning
SECTION 32. (1)
Notwithstanding any other law limiting expenditures, the amount of $128,919,263
is established for the fiscal year beginning July 1, 2003, as the maximum limit
for payment of expenses from lottery moneys allocated from the Administrative
Services Economic Development Fund to the Department of Education for the State
School Fund.
(2) Notwithstanding any other law limiting expenditures, the amount of $134,181,273 is established for the fiscal year beginning July 1, 2004, as the maximum limit for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the Department of Education for the State School Fund.
SECTION 33. (1)
For the fiscal year beginning July 1, 2004, in addition to and not in lieu of
any other allocation from the Administrative Services Economic Development
Fund, there is allocated from the Administrative Services Economic Development
Fund, to the Department of Education for the State School Fund, the amount that
is in the Administrative Services Economic Development Fund during the biennium
beginning July 1, 2003, that has not been allocated by any other law for
specific purposes, but the amount may not exceed $167,000,000.
(2) Notwithstanding any other law limiting expenditures of the Department of Education for the payment of expenses of the department from lottery moneys allocated from the Administrative Services Economic Development Fund to the department for the State School Fund, for the fiscal year beginning July 1, 2004, the limitation on expenditures for the department established by section 32 (2) of this 2003 Act, is increased by $67,000,000.
SECTION 34. Notwithstanding
any other law limiting expenditures, the amount of $122,000,000 is established
for the fiscal year beginning
SECTION 35. Notwithstanding any other law limiting expenditures, the amount of $1,947,240 is established for the fiscal year beginning July 1, 2003, as the maximum limit for payment of expenses by the Department of Education from moneys received from the Western Oregon Timber Tax Account, the Eastern Oregon Timber Tax Account, the Western Oregon Timber Severance Tax Fund and the Eastern Oregon Timber Severance Tax Fund for the State School Fund.
SECTION 36. Notwithstanding any other law limiting expenditures, the amount of $992,091 is established for the fiscal year beginning July 1, 2004, as the maximum limit for payment of expenses by the Department of Education from moneys received from the Western Oregon Timber Tax Account, the Eastern Oregon Timber Tax Account, the Western Oregon Timber Severance Tax Fund and the Eastern Oregon Timber Severance Tax Fund for the State School Fund.
SECTION 37. (1)
Sections 38 to 40 of this 2003 Act become operative only if the estimate of
General Fund revenues for the biennium beginning July 1, 2003, that is
scheduled to be issued by the Oregon Department of Administrative Services in
June 2004, is more than $100,000,000 above the end-of-session estimate that is
reported to the Emergency Board under ORS 291.349 (1).
(2)
If the condition specified in subsection (1) of this section is met, sections
38 to 40 of this 2003 Act become operative on
SECTION 38. The
Oregon Department of Administrative Services shall calculate the following:
(1)
The amount by which the estimate of General Fund revenues for the biennium
beginning July 1, 2003, that is scheduled to be issued by the Oregon Department
of Administrative Services in June 2004, exceeds the end-of-session estimate
that is reported to the Emergency Board under ORS 291.349 (1).
(2) The amount that is equal to the amount calculated under subsection (1) of this section minus $100,000,000.
SECTION 39. In addition to and not in lieu of any other appropriation, there is appropriated to the Department of Education for the State School Fund, out of the General Fund, for the fiscal year beginning July 1, 2004, 50 percent of the amount identified under section 38 (2) of this 2003 Act.
SECTION 40. (1)
Notwithstanding sections 33 and 39 of this 2003 Act, no more than a total of
$167,000,000 may be appropriated or allocated under sections 33 and 39 of this
2003 Act.
(2)
If the amounts appropriated or allocated exceed the limitation established in
subsection (1) of this section:
(a)
The appropriation made under section 39 of this 2003 Act shall be reduced until
the total appropriation and allocation is under the limitation; and
(b) If necessary, the allocation made under section 33 of this 2003 Act shall be reduced until the total appropriation and allocation is under the limitation.
SECTION 41. Notwithstanding any other law limiting expenditures, the amount of $14,252,379 is established for the fiscal year beginning July 1, 2004, as the maximum limit for payment of expenses from the State School Fund by the Department of Education from moneys received from the State Treasurer under section 40 (2)(a), chapter 709, Oregon Laws 2003 (Enrolled House Bill 2152), as the deposit from revenues received due to a change in the rate of discount for payment of property taxes on or before November 15, 2004.
SECTION 42. Section 3, chapter 13, Oregon Laws 2002 (third special session), is amended to read:
Sec. 3. If the amendment to section 4, Article XV, Oregon Constitution, proposed by House Joint Resolution 80 (2002 third special session) is approved by the people at an election held throughout this state during the 2002 calendar year, then, on the effective date of that amendment, in addition to and notwithstanding any other law, the amount of $150,000,000 is established for the fiscal year beginning July 1, 2002, as the maximum limit for payment of expenses by the Department of Education from lottery moneys transferred from the Education Stability Fund to the State School Fund.
SECTION 43. Section 7, chapter 9, Oregon Laws 2003 (Enrolled Senate Bill 5548), is amended to read:
Sec. 7. (1) The expenditure limitation established by section 3, chapter 13, Oregon Laws 2002 (third special session), for expenditure of lottery moneys by the Department of Education transferred from the Education Stability Fund to the State School Fund for the fiscal year beginning July 1, 2002, is increased by $112,000,000.
(2) The General Fund appropriation to the Department of Education by section 2, chapter 890, Oregon Laws 2001, for the fiscal year beginning July 1, 2002, for the State School Fund is reduced by $112,000,000.
SECTION 44. Notwithstanding any other law limiting expenditures of the Department of Education for the payment of expenses of the department for the State School Fund from moneys received from the Western Oregon Timber Tax Account, the Western Oregon Timber Tax Reserve Account and the Eastern Oregon Timber Tax Account, for the fiscal year ending June 30, 2003, the limitation on expenditures for the department for the State School Fund established by section 10, chapter 890, Oregon Laws 2001, as modified by Emergency Board action, is increased by $2,014,263.
SECTION 45. Of the amounts distributed to the public school system from the State School Fund for the fiscal year beginning July 1, 2003, pursuant to section 30 of this 2003 Act, an amount determined by the Department of Revenue to be the amount of reduction pursuant to ORS 310.228 for school districts and education service districts is specifically designated as replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution. If any additional amounts are distributed from the State School Fund for the fiscal year beginning July 1, 2003, these amounts are not replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution.
SECTION 46. Of the amounts distributed to the public school system from the State School Fund for the fiscal year beginning July 1, 2004, pursuant to section 31 of this 2003 Act, an amount determined by the Department of Revenue to be the amount of reduction pursuant to ORS 310.228 for school districts and education service districts is specifically designated as replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution. If any additional amounts are distributed from the State School Fund for the fiscal year beginning July 1, 2004, these amounts are not replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution.
SECTION 47. The
allocation of moneys from the Administrative Services Economic Development Fund
under section 33 of this 2003 Act is subject to the requirements of section 4,
Article XV of the Oregon Constitution, for deposit of specified amounts of the
net proceeds from the Oregon State Lottery into the Education Stability Fund
and into the Parks and Natural Resources Fund and shall be made only after
satisfaction or payment of:
(1)
Amounts allocated to Westside lottery bonds issued under ORS 391.140 or to the
reserves or any refunding related to the Westside lottery bonds in accordance
with the priority for allocation and disbursement established by ORS 391.130;
(2)
All liens, pledges or other obligations relating to lottery bonds or refunding
lottery bonds that are due or payable during the biennium beginning July 1,
2003; and
(3)
Amounts required by any other pledges of, or liens on, net proceeds from the

SECTION 52. (1)
For the biennium beginning July 1, 2003, expenditures by the Department of
Higher Education of moneys from gift, grant and contract activities, noncredit
continuing education, auxiliary enterprise activities, user fee supported
education and public service activities and student aid programs, excluding fee
remissions, for gift, grant and contract activities, noncredit continuing
education, auxiliary enterprise activities, user fee supported education and
public service activities and student aid programs, excluding fee remissions,
are not limited.
(2) For the biennium beginning July 1, 2003, expenditures by the department of moneys from fees, moneys or other revenues for debt service or for administrative costs relating to debt service on bonds sold pursuant to Article XI-F(1) of the Oregon Constitution are not limited.
BUREAU OF LABOR AND INDUSTRIES
SECTION 53. There
is appropriated to the Bureau of Labor and Industries, for the biennium
beginning

Notwithstanding any other law limiting expenditures, the amount of $1,610,745 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Office of the Governor.

SECTION 62. (2) In addition to and not in lieu of any other appropriation, including the appropriation made by section 64 of this 2003 Act, any difference between the amount appropriated by section 5 (1), chapter 879, Oregon Laws 2001, as subsequently modified by any 2002 special sessions actions, and the amount actually expended within the appropriation on or before June 30, 2003, is considered an appropriation for payment of expenses of the Seventy-second Legislative Assembly.
SECTION 66. Notwithstanding any other law limiting expenditures, the amount of $193,182 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Legislative Assembly of the State of Oregon.
SECTION 67. For the biennium beginning July 1, 2003, expenditures by the Legislative Administration Committee from the Lounge Revolving Account established by ORS 171.117 for the costs of food served in members’ lounges and reimbursed through receipts on the basis of sales or by payroll deductions from members are not limited.
SECTION 68. There
is appropriated to the Legislative Counsel Committee, for the biennium
beginning

Notwithstanding any other law limiting expenditures, the amount of $1,079,886 is established for the biennium beginning July 1, 2003, as the maximum limit to be paid by the Legislative Counsel Committee from the ORS Revolving Account established by ORS 171.305 for personnel costs connected with the editing of the Oregon Revised Statutes.
SECTION 70. Notwithstanding any other law limiting expenditures, the amount of $116,982 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Legislative Counsel Committee from state agencies or other offices for bill drafting and any other legal services authorized or required by law to be rendered by the Legislative Counsel Committee, including duties under ORS 183.710 to 183.725 provided pursuant to policies established by the Legislative Counsel Committee.
SECTION 71. For the biennium beginning July 1, 2003, expenditures by the Legislative Counsel Committee from the ORS Revolving Account established by ORS 171.305 and from the Legislative Publications Account established by ORS 171.245 for services and supplies connected with printing and distributing legislative publications and the Oregon Revised Statutes are not limited.

SECTION 88. CONFLICT AMENDMENTS
SECTION 91. If House Bill 5067 becomes law, section 15, chapter 732, Oregon Laws 2003 (Enrolled House Bill 5067), is amended to read:
Sec. 15. If [Senate Bill 467] House Bill 2011 becomes law, there is allocated for the biennium beginning July 1, 2003, from the Administrative Services Economic Development Fund to the office of the Governor, the amount of $610,000 for expenses of the Economic Revitalization Team established in [section 4, chapter ___, Oregon Laws 2003 (Enrolled Senate Bill 467)] section 13, chapter 800, Oregon Laws 2003 (Enrolled House Bill 2011).
SECTION 92. If House Bill 5067 becomes law, section 20, chapter 732, Oregon Laws 2003 (Enrolled House Bill 5067), is amended to read:
Sec. 20. Notwithstanding any other law limiting expenditures of the Economic and Community Development Department for the payment of debt service from lottery moneys allocated from the Administrative Services Economic Development Fund, for the biennium beginning July 1, 2003, the limitation on expenditures for the department for the debt service on lottery bonds for small port projects and channel deepening authorized under [section 1 (5), chapter___, Oregon Laws 2003 (Enrolled Senate Bill 890)] section 3 (5), chapter 741, Oregon Laws 2003 (Enrolled House Bill 3446), and ORS 285B.551 (5) and lottery bonds issued for channel deepening under ORS 285B.551 (3) and section 6, chapter 942, Oregon Laws 2001, from moneys allocated from the Administrative Services Economic Development Fund by section 3 (5), chapter 722, Oregon Laws 2003 (Enrolled House Bill 5013), is increased by $3,605,190.
SECTION 93. If House Bill 5067 becomes law, section 21, chapter 732, Oregon Laws 2003 (Enrolled House Bill 5067), is amended to read:
Sec. 21. Notwithstanding any other law limiting expenditures of the Department of Higher Education for the payment of expenses of the department from lottery moneys allocated from the Sports Lottery Account, for the biennium beginning July 1, 2003, the limitation on expenditures for the department established by [section 3, chapter ___, Oregon Laws 2003 (Enrolled House Bill 5021)] section 50 of this 2003 Act, is increased by $388.
SECTION 94. If House Bill 5067 becomes law, section 22, chapter 732, Oregon Laws 2003 (Enrolled House Bill 5067), is amended to read:
Sec. 22. Notwithstanding any other law limiting expenditures of the Department of Higher Education for the payment of expenses by the department from lottery moneys allocated from the Administrative Services Economic Development Fund for debt service on outstanding lottery bonds, for the biennium beginning July 1, 2003, the limitation on expenditures for the department established by [section 4, chapter ___, Oregon Laws 2003 (Enrolled House Bill 5021)] section 51 of this 2003 Act, is decreased by $43,233.
SECTION 95. If House Bill 5067 becomes law, section 25, chapter 732, Oregon Laws 2003 (Enrolled House Bill 5067), is amended to read:
Sec. 25. Notwithstanding any other law limiting expenditures, the amount of $610,000 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses of the Economic Revitalization Team established in [section 4, chapter___, Oregon Laws 2003 (Enrolled Senate Bill 467)] section 13, chapter 800, Oregon Laws 2003 (Enrolled House Bill 2011), from lottery moneys allocated to the office of the Governor from the Administrative Services Economic Development Fund.
MISCELLANEOUS
SECTION 96. (1)
Notwithstanding any other law, if House Bill 2368 does not become law, the
General Fund appropriation provided to the Department of Human Services for the
biennium beginning July 1, 2003, for Health Services by section 1 (4), chapter
726, Oregon Laws 2003 (Enrolled House Bill 5030), is reduced by $2,391,000.
(2) Notwithstanding any other law, if House Bill 2368 does not become law, the limitation on expenditures established by section 2 (4), chapter 726, Oregon Laws 2003 (Enrolled House Bill 5030), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, tobacco tax receipts and Medicare receipts, and including federal funds for indirect cost recovery, collected or received by the Department of Human Services, is increased by $2,391,000.
SECTION 97. (1)
Notwithstanding any other law, if House Bill 2368 does not become law, the
General Fund appropriation provided to the Department of Revenue for the
biennium beginning July 1, 2003, by section 1, chapter 497, Oregon Laws 2003
(Enrolled Senate Bill 5542), is increased by $3,098,191.
(2) Notwithstanding any other law, if House Bill 2368 does not become law, the limitation on expenditures established by section 5, chapter 497, Oregon Laws 2003 (Enrolled Senate Bill 5542), for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, except those deposited in the Multistate Tax Commission Revolving Account and the Senior Property Tax Deferral Revolving Account, but excluding lottery funds and federal funds, collected or received by the Department of Revenue, is decreased by $3,098,191.
SECTION 98. The unit captions used in this 2003 Act are provided only for the convenience of the reader and do not become part of the statutory law of this state or express any legislative intent in the enactment of this 2003 Act.
SECTION 99. This
2003 Act being necessary for the immediate preservation of the public peace,
health and safety, an emergency is declared to exist, and this 2003 Act takes
effect
