Chapter 721 Oregon Laws 2003
AN ACT

Relating to the financial administration of the Department of Community Colleges and Workforce Development; creating new provisions; amending section 1, chapter 900, Oregon Laws 1999, and section 9, chapter 910, Oregon Laws 1999; appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. There is appropriated to the Department of Community Colleges and Workforce Development, for the biennium beginning July 1, 2003, out of the General Fund, the following amounts for the following purposes:
(1) Operations..................................... $ 2,051,881
(2) Community College Support Fund
for
distribution to community
college
districts and community
college
service districts................. $ 414,400,404
(3) Debt service on the outstanding
general
obligation bonds sold
pursuant
to Article XI-G
of the Oregon Constitution........... $ 3,316,055
SECTION 2. Notwithstanding any other law limiting expenditures, there are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, but excluding lottery funds and federal funds, collected or received by the Department of Community Colleges and Workforce Development the following amounts for the following purposes:
(1) Department of Community
Colleges
and Workforce
Development................................. $ 10,864,829
(2) Oregon Youth Conservation
Corps.............................................. $ 1,971,138
SECTION 3. Notwithstanding any other law limiting expenditures, the amount of $123,383,620 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from federal funds collected or received by the Department of Community Colleges and Workforce Development.
SECTION 4. For the biennium beginning July 1, 2003, expenditures for payments to individuals, organizations or units of government from federal National Emergency Grant funds are not limited.
SECTION 5. In addition to and notwithstanding any other law limiting expenditures, the amount of $316,292 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses by the Department of Community Colleges and Workforce Development from moneys received from the Western Oregon Timber Tax Account, the Eastern Oregon Timber Tax Account, the Western Oregon Timber Severance Tax Fund and the Eastern Oregon Timber Severance Tax Fund for the Community College Support Fund.
SECTION
6. (1) In addition to and not in
lieu of any other appropriation, there is appropriated to the Emergency Board,
for the biennium beginning July 1, 2003, out of the General Fund, the amount of
$10,700,000 to be allocated by the Emergency Board to the Department of
Community Colleges and Workforce Development for the Community College Support
Fund to enhance funding subsequent to the development of a revised distribution
formula for the Community College Support Fund for the fiscal year beginning
July 1, 2004.
(2) If any of the moneys appropriated in subsection (1) of this section are not allocated or obligated by the Emergency Board prior to April 1, 2004, such unallocated or unobligated moneys on that date become available for any other purpose for which the Emergency Board lawfully may allocate funds.
SECTION 7. Section 1, chapter 900, Oregon Laws 1999, is amended to read:
Sec. 1. In addition to and not in lieu of any other appropriation, there is appropriated to the [Office] Department of Community [College Services] Colleges and Workforce Development, for the biennium beginning July 1, 1999, out of the General Fund, for the following programs:
(1) Distance learning
efforts.............................................. $ 1,000,000
(2) Distribution to
community college districts
that were established or that have
annexed new territory
on or after July 1, 1995.................... $ 290,000
(3) Renovations of a facility
in [Troutdale] Gresham for Mt.
Hood Community College................ $ 100,000
(4) Mental Health
Technician Pilot Project
at Rogue Community
College............................................ $ 70,000
SECTION 8. Section 9, chapter 910, Oregon Laws 1999, is amended to read:
Sec. 9. In addition to and not in lieu of any other appropriation, there is appropriated to the [Office] Department of Community [College Services] Colleges and Workforce Development, out of the General Fund, for the biennium beginning July 1, 1999, the following amounts for the following purposes:
(1) Renovations of a facility
in [Troutdale] Gresham for Mount
Hood Community College................ $ 100,000
(2) For facilities at the
Woodburn campus of
Chemeketa Community
College............................................ $ 200,000
SECTION 9. Of the amounts distributed to the public school system from the Community College Support Fund pursuant to ORS 341.626 for the fiscal year beginning July 1, 2003, by section 1 (2) of this 2003 Act, an amount equal to the amount determined by the Department of Revenue to be the amount of reduction pursuant to ORS 310.228 for community college districts and community college service districts is specifically designated as replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution. If any additional amounts are distributed from the Community College Support Fund pursuant to ORS 341.626 for the fiscal year beginning July 1, 2003, these amounts are not replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution.
SECTION 10. Of the amounts distributed to the public school system from the Community College Support Fund pursuant to ORS 341.626 for the fiscal year beginning July 1, 2004, by section 1 (2) of this 2003 Act, an amount equal to the amount determined by the Department of Revenue to be the amount of reduction pursuant to ORS 310.228 for community college districts and community college service districts is specifically designated as replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution. If any additional amounts are distributed from the Community College Support Fund pursuant to ORS 341.626 for the fiscal year beginning July 1, 2004, these amounts are not replacement revenue within the meaning of section 11 (9), Article XI of the Oregon Constitution.
SECTION 11. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
