AN ACT
HB 5030
Relating to the financial administration of the Department of Human Services; appropriating money; limiting expenditures; and declaring an emergency.
Be It Enacted by the People of the State of
Oregon:
SECTION 1. There is appropriated to the Department of Human Services, for the biennium beginning July 1, 2003, out of the General Fund, the following amounts for the following purposes:
(1) Department-wide Support

SECTION 2. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from fees, moneys or other revenues, including Miscellaneous Receipts, tobacco tax receipts and Medicare receipts, and including federal funds for indirect cost recovery, collected or received by the Department of Human Services for the following purposes:

SECTION 3. Notwithstanding any other law limiting expenditures, the amount of $5,600,000 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from lottery moneys allocated from the Administrative Services Economic Development Fund to the Department of Human Services for gambling addiction treatment and prevention.
SECTION 4. Notwithstanding any other law limiting expenditures, the following amounts are established for the biennium beginning July 1, 2003, as the maximum limits for payment of expenses from federal funds, but excluding federal funds for indirect cost recovery, collected or received by the Department of Human Services for the following purposes:

SECTION 5. For the biennium beginning July 1, 2003, expenditures for Women, Infants and Children nutrition program food vouchers, federal food stamp benefit payments and Community Health Insurance Program reimbursable drug purchases are not limited.
SECTION 6. This 2003 Act does not prohibit the Department of Human Services from transferring funds and expenditure limitations among programs identified in a single subsection of section 1, 2 or 4 of this 2003 Act.
SECTION 7. Notwithstanding ORS 413.029 and the definition of public assistance in ORS 411.010, the funds appropriated by section 1 of this 2003 Act may not be used to meet the costs of burials, except for persons in the care and custody of the Department of Human Services.
SECTION 8. Notwithstanding any other law limiting expenditures, the amount of $8,208,216 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from moneys transferred to the Department of Human Services from the Health Care Trust Fund established in ORS 293.540 for medical assistance programs.
SECTION 9. Notwithstanding any other law limiting expenditures, the amount of $34,000,000 is established for the biennium beginning July 1, 2003, as the maximum limit for payment of expenses from moneys transferred to the Department of Human Services from the Tobacco Settlement Funds Account established in ORS 293.537 for medical assistance programs.
SECTION 10. In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, for the biennium beginning July 1, 2003, out of the General Fund, the amount of $6,317,994 for allocation to the Department of Human Services for community program costs for the plan for universal access to services for people with developmental disabilities. If any of the moneys described in this section are not allocated by the Emergency Board prior to January 1, 2005, the unallocated moneys become available for any other purpose for which the Emergency Board may lawfully allocate funds.
SECTION 11. In addition to and not in lieu of any other appropriation, there is appropriated to the Emergency Board, for the biennium beginning July 1, 2003, out of the General Fund, the amount of $8,000,000 for allocation to the Department of Human Services for the state medical assistance program. If any of the moneys described in this section are not allocated by the Emergency Board prior to January 1, 2005, the unallocated moneys become available for any other purpose for which the Emergency Board may lawfully allocate funds.
SECTION 12. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
