Chapter 758 Oregon Laws 2003

 

AN ACT

 

SB 899

 

Relating to public contract for motor vehicle plates; creating new provisions; amending ORS 282.210 and 282.220; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. In 2003, the Department of Transportation shall advertise for bids on a public contract for the purchase of motor vehicle registration plates and plates required to be affixed to motor carriers on the first anniversary of the date such a public contract was executed in 2002.

 

          SECTION 2. ORS 282.210 is amended to read:

          282.210. (1) Except as provided in subsection (2) of this section, all printing, binding and stationery work, including the manufacture of motor vehicle registration plates and plates required to be affixed to motor carriers, for the state or any county, city, town, port district, school district, or other political subdivision thereof, shall be performed within the state. All requests for bids and all contracts for such work shall so stipulate.

          (2) The work referred to in subsection (1) of this section may be performed outside the state if it is established that:

          (a) The work cannot be performed within the state;

          (b) The lowest price for which such work can be procured within the state exceeds the charge usually and customarily made to private individuals and corporations for work of similar character and quality; or

          (c) All bids for the work, or any part thereof, are excessive and not reasonably competitive.

 

          SECTION 3. ORS 282.220 is amended to read:

          282.220. No payment shall be made by the state or any political subdivision thereof for printing, binding or stationery work, including the manufacture of motor vehicle registration plates and plates required to be affixed to motor carriers, unless it appears that such work was done within the state, or was authorized to be done outside the state pursuant to ORS 282.210.

 

          SECTION 4. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect on its passage.
