AN ACT

 

HB 2288

 

Relating to Department of Human Services budget determinations for type B area agencies; and declaring an emergency.

 

Be It Enacted by the People of the State of Oregon:

 

          SECTION 1. Section 2 of this 2003 Act is added to and made a part of ORS 410.040 to 410.320.

 

          SECTION 2. The Department of Human Services shall:

          (1) Adopt by rule a methodology for determining annual budget levels for type B area agencies for planning and administering programs for elderly persons and persons with disabilities that:

          (a) Includes both direct and indirect costs; and

          (b) Results in a budget level for a type B area agency that is not less than 95 percent of the amount that would otherwise be budgeted for a local department office serving elderly persons and persons with disabilities;

          (2) Determine annual budget levels for planning and administering programs for elderly persons and persons with disabilities for type B area agencies using the methodology adopted under subsection (1) of this section; and

          (3) Consider the budget levels determined under subsection (2) of this section when making recommendations to the Governor on the level of funding for type B area agencies each biennium.

 

          SECTION 3. Section 2 of this 2003 Act applies to biennia beginning on or after July 1, 2003.

 

          SECTION 4. Before adopting the rules described in section 2 of this 2003 Act, the Department of Human Services shall consult with representatives of type B area agencies.

 

          SECTION 5. This 2003 Act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this 2003 Act takes effect July 1, 2003.
