SUMMARY
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Establishes statewide recycling and recovery goal for waste
tires. Modifies purposes for which Waste Tire Recycling Account
may be used. Directs Environmental Quality Commission to increase
per-ton fee if statewide goal for waste tires is not met.
A BILL FOR AN ACT
Relating to waste tires; creating new provisions; amending ORS
459.775 and 459A.115; and appropriating money.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2003 Act is added to and made
a part of ORS 459.705 to 459.790. + }
SECTION 2. { + It is the goal of the State of Oregon that by
January 1, 2007, the amount of recycling and recovery of waste
tires shall be at least 60 percent and that by January 1, 2010,
the amount of recycling and recovery of waste tires shall be at
least 80 percent. + }
SECTION 3. ORS 459.775 is amended to read:
459.775. { - (1) - } The Waste Tire Recycling Account is
established in the State Treasury, separate and distinct from the
General Fund. { - All moneys received by the Department of
Revenue under ORS 459.504 to 459.619 (1989 Edition) shall be
deposited to the credit of the account. - }
{ - (2) Any moneys remaining in the Waste Tire Recycling
Account on July 1, 1992, and any interest earned on such moneys
are - } { + All moneys received pursuant to ORS 459A.115 (2)
shall be deposited in the General Fund and credited to the
account. Interest earned on moneys in the account accrues to the
account. Moneys in the account are + }appropriated continuously
to the Department of Environmental Quality { - and shall - }
{ + to + } be used { - : - }
{ - (a) To reimburse users for the costs of using waste tires
or chips or similar material for requests made for the calendar
quarter immediately preceding July 1, 1992; and - }
{ - (b) - } by the department { - of Environmental
Quality - } for
{ - other - } programs and activities related to waste tire
{ + market development, public education, public outreach, + }
storage, removal or disposal.
SECTION 4. ORS 459A.115 is amended to read:
459A.115. { - (1) From January 1, 1992, to December 31, 1993,
the schedule of fees as established by the Environmental Quality
Commission under ORS 459A.110 (1) is increased by 35 cents per
ton. The portion of the fees attributable to the 35 cents per ton
increase shall be deposited into the General Fund and credited to
an account of the Department of Environmental Quality. Such
moneys are continuously appropriated to the department to
implement the provisions of this section and ORS 459.005,
459.015, 459.235, 459.247, 459.418, 459.995, 459A.005, 459A.010,
459A.020, 459A.030 to 459A.055, 459A.070, 459A.110, 459A.500 to
459A.685, 459A.695 and 459A.750. - }
{ - (2) - } { + (1) + } { - Beginning January 1,
1994, - } The schedule of fees as established by the
{ + Environmental Quality + } Commission under ORS 459A.110 is
increased by 31 cents per ton and { + the additional amount + }
shall be deposited into the General Fund and credited to an
account of the department. Such moneys are continuously
appropriated to the department to implement { - the provisions
described in subsection (1) of this section, excluding ORS
459.418. - } { + ORS 459.005, 459.015, 459.235, 459.247,
459.995, 459A.005, 459A.010, 459A.020, 459A.030 to 459A.055,
459A.070, 459A.110, 459A.500 to 459A.685, 459A.695 and 459A.750.
(2) If the commission determines that the goal established in
section 2 of this 2003 Act of recycling and recovering 60 percent
of waste tires by January 1, 2007, has not been achieved, the
commission shall increase the schedule of fees as established by
the commission under ORS 459A.110 by 25 cents per ton. The
additional moneys collected from this increase shall be deposited
into the General Fund and credited to the Waste Tire Recycling
Account established under ORS 459.775. The commission shall
discontinue the 25-cents-per-ton increase if the commission
determines that the goal established in section 2 of this 2003
Act of recycling and recovering 80 percent of waste tires by
January 1, 2010, has been achieved. + }
