SUMMARY

brief statement of the essential features of the measure.
Directs Department of Environmental Quality to use moneys in
Waste Tire Recycling Account for waste tire market development
and education and outreach. { + Transfers funds from Waste Tire
Recycling Account to State Police Account for patrol services
activities and operations.
Increases expenditure limitation for Department of State Police
for patrol services activities and operations.
Declares emergency, effective on passage. + }
A BILL FOR AN ACT
Relating to the Waste Tire Recycling Account; creating new
provisions; amending ORS 459.775; limiting expenditures; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 459.775 is amended to read:
459.775. (1) The Waste Tire Recycling Account is established in
the State Treasury, separate and distinct from the General Fund.
All moneys received by the Department of Revenue under ORS
459.504 to 459.619 (1989 Edition) shall be deposited to the
credit of the account.
(2) Any moneys remaining in the Waste Tire Recycling Account on
July 1, 1992, and any interest earned on such moneys are
appropriated continuously to the Department of Environmental
Quality and shall be used:
(a) To reimburse users for the costs of using waste tires or
chips or similar material for requests made for the calendar
quarter immediately preceding July 1, 1992; and
(b) By the Department of Environmental Quality for other
programs and activities related to waste tire { + market
development, education and outreach, + } storage, removal or
disposal.
SECTION 2. { + Notwithstanding the purposes for which moneys
in the Waste Tire Recycling Account may be used, and
notwithstanding the continuous appropriation of moneys in the
account to the Department of Environmental Quality pursuant to
ORS 459.775, the amount of $625,000 is transferred from the Waste
Tire Recycling Account to the State Police Account established
pursuant to ORS 181.175 to be expended for Department of State
Police patrol services activities and operations. + }
SECTION 3. { + Notwithstanding any other law limiting
expenditures, the limitation on expenditures established by
section 2 (1), chapter 776, Oregon Laws 2001, for the biennium
beginning July 1, 2001, as the maximum limit for payment of
expenses from fees, moneys or other revenues, including
Miscellaneous Receipts, but excluding lottery funds, collected or
received by the Department of State Police, is increased by
$625,000 for the purposes of carrying out the provisions of
section 2 of this 2003 Act. + }
SECTION 4. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
