Authorizes unrestricted public use of service roads in
specified situations.
A BILL FOR AN ACT
Relating to use of service roads.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The public shall have unrestricted access
to a service road if:
(a) The service road is constructed to serve property that
loses its access to a state or county road because of
construction of an interstate highway;
(b) A court order or judgment in an eminent domain proceeding
involving the property expressly states that access to the
service road is unlimited or unrestricted; and
(c) The public uses the service road to get:
(A) To or from the property the service road was constructed to
serve; or
(B) To or from a road that goes to a property adjacent to the
property the service road was constructed to serve.
(2) The Department of Transportation may not require permits
for, or impose restrictions on, use of a service road if the use
is authorized by this section. + }
SECTION 2. { + Section 1 of this 2003 Act applies to service
roads constructed before, on or after the effective date of this
2003 Act. + }
