CHAPTER ................
AN ACT
Relating to Oregon Commission for Voluntary Action and Service;
creating new provisions; amending ORS 458.563; and declaring an
emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Oregon Commission for Voluntary Action
and Service shall make inquiries and obtain advice from
appropriate sources regarding the feasibility of having all or
some of the functions of the commission performed by a nonprofit,
tax-exempt organization that qualifies under section 501(c)(3) of
the Internal Revenue Code. All agencies of state government as
defined in ORS 174.111 are directed to cooperate with the
commission and, to the extent permitted by laws relating to
confidentiality, to furnish all information and advice necessary
to assist the commission in carrying out this subsection.
(2) The commission shall report its findings and
recommendations for legislation to the Governor and the
Seventy-third Legislative Assembly on or before January 31,
2005. + }
SECTION 2. ORS 458.563 is amended to read:
458.563. (1) The Oregon Commission for Voluntary Action and
Service shall appoint a director to serve at the pleasure of the
commission. The director must have experience and education in
public administration or nonprofit management.
(2) The designation of the director must be by written order,
filed with the Secretary of State.
(3) Subject to any applicable provisions of the State Personnel
Relations Law, the director shall appoint all subordinate
officers and employees of the commission, prescribe their duties
and fix their compensation.
(4) The director { + of the commission + } shall
{ - cooperate with - } { + report to, and comply with the
directions of, the Director of + } the Housing and Community
Services Department in the development and administration of
non-policymaking activities, including but not limited to rules
for commission personnel, fiscal practices and purchasing of
commission supplies.
SECTION 3. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
