                             SUMMARY

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Permits imposition of civil penalties for certain violations
relating to aviation. Specifies accounts into which civil
penalties must be deposited.
 
                        A BILL FOR AN ACT
Relating to aviation; creating new provisions; amending ORS
  837.990; and repealing ORS 837.100.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 837.990 is amended to read:
  837.990.   { - (1) Except as otherwise provided in this section
and subject to ORS 153.022, a person commits a Class A violation
if the person violates any provision of this chapter and ORS
chapters 835 and 836, except those provisions governing official
regulatory actions of governmental bodies, or any rule adopted
thereunder. - }
    { - (2) The offense described in ORS 837.080, prohibited
aircraft operation, is a Class B misdemeanor. - }
    { - (3) A person commits the offense of failure to register
if the person fails to register an aircraft as required by ORS
837.040. - }
   { +  (1) Subject to ORS 153.022, a person who violates ORS
836.120, 836.510, 837.010, 837.015, 837.030, 837.055, 837.065,
837.075, 837.085, 837.090 or 837.095 or a rule or order under
this chapter or ORS chapter 835 or 836 commits a Class A
violation.
  (2) The Oregon Department of Aviation may impose a civil
penalty not to exceed $500 exclusive of registration fees and
penalties for late registration on a person who:
  (a) Fails to register as a pilot under ORS 837.020; or
  (b) Fails to register an aircraft under ORS 837.040.
  (3) Civil penalties under subsection (2) of this section shall
be imposed in the manner provided in ORS 183.090.
  (4) A person who violates ORS 837.080, prohibited operation of
an aircraft, commits a Class B misdemeanor. + }
  SECTION 2.  { + (1) Civil penalties recovered under ORS 837.990
for failure to register an aircraft shall be paid into the State
Treasury and credited to the State Aviation Account.
 
 
  (2) Civil penalties recovered under ORS 837.990 for failure to
register as a pilot shall be paid into the State Treasury and
credited to the Aviation Search and Rescue Account. + }
  SECTION 3.  { + ORS 837.100 is repealed. + }
