                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
 
    { - Requires that electrical work involving installation,
alteration, maintenance and repair of elevator in private
residence after July 1, 2004, be performed by limited elevator
journeyman or limited elevator maintenance electrician. - }
  Provides for licensing of limited elevator maintenance
electricians.  { + Requires license application on or before
December 31, 2003. + } Authorizes limited elevator maintenance
electricians to perform electrical work involving installation,
alteration, maintenance and repair of elevators in private
residences. { +  Exempts applicant from penalties or prosecution
for certain prior unlicensed electrical work relating to elevator
installation, alteration, maintenance or repair. + }
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to elevator electrical work; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) As used in this section, 'elevator' has the
meaning given that term in ORS 460.005.
  (2) Notwithstanding ORS 460.045, the Department of Consumer and
Business Services shall grant a license as a limited elevator
maintenance electrician to a person who:
  (a) Applies on or before December 31, 2003;
  (b) Complies with ORS 479.510 to 479.945 and the rules adopted
thereunder;
  (c) Is licensed under ORS 460.057;
  (d) Documents to the satisfaction of the Electrical and
Elevator Board that the person possesses 2,000 hours or more of
work experience or training in the electrical aspects of elevator
installation, alteration, maintenance and repair acquired prior
to the effective date of this 2003 Act; and
  (e) Pays the licensing fee required by section 3 of this 2003
Act.
  (3) In evaluating an application under this section, the board
shall consider and give appropriate credit for all work
experience and training described in subsection (2) of this
section, regardless of whether the work was performed with or
without proper licensing or certification.
  (4) The board shall adopt temporary rules for carrying out this
section. The board shall make licensing as a limited elevator
maintenance electrician available for qualified applicants
beginning not more than 60 days after the effective date of this
2003 Act. + }
  SECTION 2.  { + Notwithstanding ORS 455.895, 460.990 or
479.995, a person who applies under section 1 of this 2003 Act
for licensing as a limited elevator maintenance electrician is
not subject to a civil penalty or criminal prosecution for
unlicensed work relating to the electrical aspects of elevator
installation, alteration, maintenance or repair in a private
residence performed prior to the later of:
  (1) Ninety days after the effective date of this 2003 Act; or
  (2) Final action by the Electrical and Elevator Board on an
application for a license under section 1 of this 2003 Act filed
on or before 90 days after the effective date of this 2003
Act. + }
  SECTION 3.  { + (1) Notwithstanding ORS 460.045, a person
licensed by the Department of Consumer and Business Services
under section 1 of this 2003 Act as a limited elevator
maintenance electrician may install, alter, maintain and repair
an elevator located in a private residence or, as provided by the
Electrical and Elevator Board by rule, dumbwaiters or other
lifting devices.
  (2) A limited elevator maintenance electrician's license is
subject to renewal as provided in ORS 479.650. The fee for the
issuance or renewal of a limited elevator maintenance
electrician's license is equal to the fee required by ORS 479.840
for issuance or renewal of a limited elevator journeyman
license. + }
  SECTION 4.  { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
