Requires that Oregon Health Plan participant be Oregon
resident. Establishes types of information that may be used to
establish residency.
A BILL FOR AN ACT
Relating to the Oregon Health Plan; amending ORS 414.032.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 414.032 is amended to read:
414.032. { + (1) + } Within the limits of funds available
{ - therefor - } , medical assistance shall be made available to
persons { + who are residents of this state + } { + and + } who
are categorically needy or medically needy.
{ + (2) In order to establish residency under subsection (1)
of this section, a person must show evidence that the person is
living in this state and intends to remain permanently or
indefinitely. A person may present one of the following to show
evidence of residency:
(a) An Oregon driver license;
(b) An Oregon identification card;
(c) A Department of Corrections inmate identification card
issued by the State of Oregon; or
(d) Two statements on forms provided by the Department of Human
Services, each signed by a current resident, certifying that the
person receiving medical assistance is a resident.
(3) The Department of Human Services shall develop a form for
the statements submitted under subsection (2)(d) of this
