  Transfers administration of mechanical code portion of state
building code to Board of Boiler Rules.
 
                        A BILL FOR AN ACT
Relating to mechanical code; creating new provisions; and
  amending ORS 455.132.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + In addition to any duties of the Board of
Boiler Rules under ORS 480.510 to 480.670, the board shall advise
the Director of the Department of Consumer and Business Services
regarding the adoption and amendment of the mechanical code of
the state building code and shall administer the mechanical
code. + }
  SECTION 2. ORS 455.132 is amended to read:
  455.132. (1) There is established in the Department of Consumer
and Business Services a Building Codes Structures Board
consisting of 15 members.
  (2) The Building Codes Structures Board shall assist the
Director of the Department of Consumer and Business Services in
administering the structural,   { - mechanical, - }  one- and
two-family dwellings, prefabricated structures and energy
programs described in this chapter and the accessibility to
persons with physical disabilities program described in ORS
447.210 to 447.280.
  (3) The board shall consist of a representative selected from
individuals recommended by the Oregon Disabilities Commission and
members broadly representative of the industries and professions
involved in the development and construction of buildings and
energy conservation, including:
  (a) An architect;
  (b) A homebuilder;
  (c) An energy supplier;
  (d) A representative of a recognized environmental group;
  (e) A prefabricated structure builder;
  (f) A representative of a fire protection agency;
  (g) A remodeler;
  (h) A low income housing representative;
  (i) An engineer;
  (j) A building official;
  (k) An owner or manager of more than two rental housing units;
  (L) An owner or manager of a commercial office building; and
  (m) Two public members who do not receive compensation from any
interest described in paragraphs (a) to (L) of this subsection.
  SECTION 3. { +  (1) The duties, functions and powers of the
Building Codes Structures Board relating to administration of the
mechanical code portion of the state building code are imposed
upon, transferred to and vested in the Board of Boiler Rules.
  (2) The chairperson of the Building Codes Structures Board
shall deliver to the chief inspector appointed under ORS 480.565
all records and property within the jurisdiction of the Building
Codes Structures Board that relate to the duties, functions and
powers transferred by subsection (1) of this section.
  (3) The Director of the Department of Consumer and Business
Services shall resolve any dispute between the Building Codes
Structures Board and the Board of Boiler Rules relating to
transfers of records and property under this section, and the
director's decision is final.
  (4) The transfer of duties, functions and powers to the Board
of Boiler Rules by subsection (1) of this section does not affect
any action, proceeding or prosecution involving or with respect
to such duties, functions and powers begun before and pending at
the time of the transfer, except that the Board of Boiler Rules
is substituted for the Building Codes Structures Board in the
action, proceeding or prosecution. + }
