                             SUMMARY

brief statement of the essential features of the measure as
introduced.
 
  Requires Economic and Community Development Department to
compile and make available record of incentives offered to
private business to encourage business to locate or expand
facility in Oregon.
 
                        A BILL FOR AN ACT
Relating to documenting business incentives.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2003 Act is added to and made
a part of ORS chapter 285A. + }
  SECTION 2. { +  (1) The Economic and Community Development
Department shall compile and make available to the public a
record of all incentives offered or proposed to be offered to a
private business by a state agency or local government for the
purpose of encouraging the business to locate or expand a
facility in this state. The record shall be maintained in a
manner that allows a person to calculate the total value of
incentives offered or proposed to be offered to the business for
any single development or expansion project.
  (2) A local government as defined in ORS 174.116 or a state
agency that offers or proposes to offer an incentive described in
subsection (1) of this section shall report the incentive to the
department. The local government or state agency making the
report shall include with the report copies of any documents
exchanged between the parties that describe terms of the
incentive, including any correspondence, memoranda, letters of
understanding, draft leases, options or other agreements.
  (3) Incentives subject to this section include but are not
limited to grants, loans, tax exemptions, tax credits,
below-market lease terms or other incentives regarding real
property, employee training agreements or other labor-related
services. Benefits available to qualified persons under ORS
285B.650 to 285B.728, 285B.766 to 285B.776 and 285B.781 to
285B.796 are not subject to the provisions of this section.
  (4) The information compiled by the department under this
section shall be available for review by the public unless exempt
from disclosure under ORS 192.501 or 192.502. + }
  SECTION 3.  { + Section 2 of this 2003 Act applies to incentive
agreements proposed or entered into on or after the effective
date of this 2003 Act. + }
