Expands membership of Construction Contractors Board.
A BILL FOR AN ACT
Relating to Construction Contractors Board; creating new
provisions; and amending ORS 701.205.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 701.205 is amended to read:
701.205. (1) The Construction Contractors Board is established,
consisting of { - nine - } { + 11 + } members appointed by
the Governor subject to confirmation by the Senate in the manner
provided by law.
{ + (a) Of the board members:
(A) + } Three { - of the members shall - } { + must + } be
contractors who primarily work on residential or small commercial
structures, including one contractor engaged in the business of
remodeling { + . + } { - , two shall be public members and one
shall be an elected representative of a governing body of local
government. - }
{ + (B) + } Two { - of the members shall - } { + must + }
be general contractors who primarily work on large commercial
structures { + . + } { - , and - }
{ + (C) + } One { - shall - } { + must + } be a specialty
contractor who primarily works on large commercial structures or
a limited contractor.
{ + (D) One must be a first-tier subcontractor.
(E) One must be a representative of persons working in building
trades.
(F) One must be an elected representative of a governing body
of local government.
(G) Two must be public members.
(b) + } One member who is a contractor may be { + a + }
certified { - as a - } home inspector.
(2) The term of office of each member is four years, but a
member serves at the pleasure of the Governor. Before the
expiration of the term of a member, the Governor shall appoint a
successor whose term begins on July 1 next following. A member is
eligible for reappointment. If there is a vacancy for any cause,
the Governor shall make an appointment immediately effective for
the unexpired term.
(3) In order to be eligible for board membership, the six
contractor members { + and the subcontractor member + }of the

order during their term of office.
SECTION 2. { + Notwithstanding the term of office specified in
ORS 701.205, the Governor may adjust and stagger the initial
terms of office of persons first appointed to the two
Construction Contractors Board positions created by the
amendments to ORS 701.205 by section 1 of this 2003 Act to ensure
that no more than three board member terms expire each year. + }
