A BILL FOR AN ACT
Relating to prescription drugs; appropriating money; and
declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) Through a request for proposal process, the
Secretary of State shall contract with an organization with
expertise in the area of prescription drug benefit plans for an
independent audit of the pharmacy benefit management company used
by the Department of Human Services' medical assistance program
to provide pharmacy benefit management services.
(2) The audit conducted under contract as provided in
subsection (1) of this section shall:
(a) Consider actions taken by the pharmacy benefit management
company on behalf of the department on or after January 1, 1990;
and
(b) Provide continuing oversight and auditing of the pharmacy
benefit management company.
(3) The Secretary of State and the department shall jointly
report the results of the audit as soon as the initial audit is
completed and periodically thereafter to the Legislative Assembly
or to the Emergency Board if the Legislative Assembly is not in
session.
(4) The Secretary of State shall seek reimbursement from the
department to cover the costs and expenses of the contract
described in subsection (1) of this section. + }
SECTION 2. { + In addition to and not in lieu of any other
appropriation, there is appropriated to the Department of Human
Services, for the biennium beginning July 1, 2003, out of the
General Fund, the amount of $___ for the purpose of carrying out
section 1 of this 2003 Act. + }
SECTION 3. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
