Extends statute of limitation from 10 to 12 years for action
for recovery of real property or for recovery of possession of
real property.
A BILL FOR AN ACT
Relating to statute of limitations; creating new provisions; and
amending ORS 12.050.
Be It Enacted by the People of the State of Oregon:
SECTION 1. ORS 12.050 is amended to read:
12.050. An action for the recovery of real property, or for the
recovery of the possession thereof, shall be commenced within
{ - 10 - } { + 12 + } years. No action shall be maintained
for such recovery unless it appear that the plaintiff, an
ancestor, predecessor, or grantor was seized or possessed of the
premises in question within
{ - 10 - } { + 12 + } years before the commencement of the
action.
SECTION 2. { + The amendments to ORS 12.050 by section 1 of
this 2003 Act apply to any action commenced as described in ORS
12.020 on or after the effective date of this 2003 Act. + }
