  On page 2 of the printed bill, line 1, delete the second ' or'.
  In line 7, delete the period and insert '; or
  ' (h) Has committed a disqualifying act described in subsection
(9) or (10) of this section.'.
  On page 3, line 23, after 'employer' insert 'or through
collective bargaining'.
  In line 32, delete 'verify the' and insert 'sign a' and after
'custody' insert 'form'.
  Delete lines 34 and 35 and insert:
  ' (iv) Placement of an adulterant in the individual's specimen
for testing, when the adulterant is identified by a testing
facility; or'.
  Delete lines 38 and 39 and insert:
  ' (D) Is under the influence of intoxicants while performing
services for the employer;'.
  In line 41, after 'work' insert a semicolon and delete the rest
of the line.
  In line 42, delete ', in-' and insert '; or'.
  Delete line 43.
  After line 45, insert:
  ' (b)(A) Except as provided in subparagraph (B) of this
paragraph, an individual is not considered to have committed a
disqualifying act under this subsection if the individual, on the
date of separation or within 10 days after the date of
separation, is participating in a recognized drug or alcohol
rehabilitation program and provides documentation of
participation in the program to the department.
  ' (B) This paragraph does not apply to an individual who has
refused to enter into or has violated the terms of a last chance
agreement with the employer.'.
  On page 4, line 1, delete '(b)' and insert '(c)' and delete
'for misconduct'.
  In line 2, delete 'misconduct' and insert 'separation'.
  In line 4, delete '(c)' and insert '(d)'.
  In line 14, after the semicolon insert 'or'.
  Delete line 15.
  In line 16, delete '(e)' and insert '(d)'.
  After line 37, insert:
  ' (a) 'Adulterant' means a substance that does not occur
naturally in urine, or that occurs naturally in urine but not at
the concentrations detected. 'Adulterant' includes but is not
limited to glutaraldehyde, nitrite concentrations above
physiological levels, hypochlorite or soap.'.
  In line 38, delete '(a)' and insert '(b)'.
  In line 39, delete '(b)' and insert '(c)'.
  In line 41, delete 'misconduct' and insert 'use'.
  On page 5, line 3, delete '(c)' and insert '(d)'.
