SUMMARY

Requires owner of greyhound used in race meets in state to file
form with Oregon Racing Commission upon disposition of greyhound.

A BILL FOR AN ACT
Relating to greyhounds.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Sections 2, 3 and 6 of this 2003 Act are added
to and made a part of ORS chapter 462. + }
SECTION 2. { + As used in section 3 of this 2003 Act, '
disposition' means the suspension or termination of the use of a
greyhound in race meets in this state. 'Disposition' includes,
but is not limited to:
(1) Transfer to a race track in another jurisdiction;
(2) Retirement for breeding;
(3) Adoption or placement for adoption;
(4) Euthanasia; and
(5) Sale or donation, including but not limited to, sale or
donation for medical research. + }
SECTION 3. { + (1) The Oregon Racing Commission shall adopt
rules to regulate the disposition of greyhounds.
(2) The commission shall maintain records and statistics
regarding the disposition of greyhounds. A record must include:
(a) The registered name of the greyhound;
(b) The left and right ear tattoo numbers of the greyhound;
(c) The names, business addresses and telephone numbers of the
owner, trainer and kennel operator for the greyhound at the time
of disposition;
(d) The name and address of the race track where the greyhound
last raced;
(e) If the greyhound has been transferred to a race track in
another jurisdiction:
(A) The name and address of the race track that received the
greyhound; and
(B) The name, business address, telephone number and driver
license state and number of the person who received the greyhound
on behalf of the other track;
(f) If the greyhound has been retired for breeding:
(A) The name and address of the facility that received the
greyhound; and
(B) The name, business address, telephone number and driver
license state and number of the person who received the greyhound
on behalf of the facility;
(g) If the greyhound has been adopted or placed for adoption:
(A) The name, address and telephone number of the adopting
person or the adoption facility that received the greyhound; and
(B) If applicable, the name, business address, telephone number
and driver license state and number of the person who received
the greyhound on behalf of the adoption facility;
(h) If the greyhound has been euthanized:
(A) The name, address, professional title and professional
affiliation of the person performing the euthanasia;
(B) The manner of euthanasia; and
(C) A detailed statement of reasons the greyhound was
euthanized rather than adopted or placed for adoption;
(i) If the greyhound has been sold or donated to an individual,
corporation or other entity:
(A) The name and address of the individual, corporation or
other entity purchasing or receiving the greyhound;
(B) The use for which the greyhound was sold or donated; and
(C) The name, business address, telephone number and driver
license state and number of the person who received the greyhound
on behalf of the individual, corporation or other entity; and
(j) If paragraphs (e) to (i) of this subsection do not apply, a
detailed statement by the owner, trainer or kennel operator for
the greyhound that includes:
(A) The destination of the greyhound;
(B) The name, business address, telephone number and driver
license state and number of the person who received the
greyhound; and
(C) The specific intended use of the greyhound.
(3) Within 10 days after disposition of a greyhound, the owner
shall file a greyhound disposition form with the commission. The
commission may accept the filing of a disposition form by the
trainer or kennel operator for the greyhound as agents of the
owner. A greyhound disposition form must contain all information
described in subsection (2) of this section that applies to the
disposition. The commission may not accept a greyhound
disposition form for filing unless the owner, trainer or kennel
operator filing the form signs the form under penalty of perjury
in the presence of a designated representative of the commission.
(4) The commission shall retain a greyhound disposition form
for at least seven years and make the form available for public
inspection during normal business hours of the commission. + }
SECTION 4. { + (1) A person commits the crime of filing a
false greyhound disposition form if a greyhound owned by the
person and used by or on behalf of the person in race meets in
this state is disposed of and the person:
(a) Fails to timely file a greyhound disposition form with the
Oregon Racing Commission as required by section 3 of this 2003
Act; or
(b) Knowingly files, or causes to be filed, with the commission
a greyhound disposition form that contains incomplete, false or
misleading information.
(2) Failure to file a valid greyhound disposition form is an
unclassified felony punishable by imprisonment for a period of
not more than two years, a fine of $2,500, or both. + }
SECTION 5. { + (1) A person commits the crime of aggravated
failure to file a valid greyhound disposition form if the person:
(a) Commits an act described in section 4 of this 2003 Act; and
(b) Has previously been convicted under this section or section
4 of this 2003 Act.
(2) Aggravated failure to file a valid greyhound disposition
form is an unclassified felony punishable by imprisonment for a
period of not more than five years, a fine of $5,000, or
both. + }
SECTION 6. { + (1) The Oregon Racing Commission shall adopt
rules governing the reporting of injuries incurred by greyhounds
while participating in races in this state.
(2) The commission shall maintain records and statistics
regarding injuries incurred by greyhounds while participating in
races in this state. A record must include:
(a) The registered name of the greyhound;
(b) The left and right ear tattoo numbers of the greyhound;
(c) The names, business addresses and telephone numbers of the
owner, trainer and kennel operator for the greyhound;
(d) The color, weight and sex of the greyhound;
(e) Whether the greyhound incurred the injury on the race track
or elsewhere in the race facility; and
(f) If the greyhound incurred the injury while racing:
(A) The name of the race facility where the injury occurred;
(B) The distance, grade and race in which the greyhound
incurred the injury;
(C) The post position of the greyhound;
(D) The weather, time, temperature and track condition at the
time the greyhound incurred the injury;
(E) The specific type of injury and location on the greyhound;
(F) The cause of the injury; and
(G) The estimated time required for the greyhound to recover.
(3) Within 10 days after a greyhound incurs an injury while
participating in a race in this state, the commission
veterinarian for the race meet shall file a greyhound injury
report with the commission. The report must contain all
information described in subsection (2) of this section that
applies to the injury. The commission may not accept a greyhound
injury report for filing unless the commission veterinarian
filing the report signs the report under penalty of perjury in
the presence of a designated representative of the commission.
(4) The commission shall retain a greyhound injury report for
at least seven years and make the report available for public
inspection during normal business hours of the commission. + }
SECTION 7. { + (1) A person commits the crime of failure to
file a valid greyhound injury report if the person is an Oregon
Racing Commission veterinarian for a race meet and the person:
(a) Fails to timely file a greyhound injury report with the
commission as required by section 6 of this 2003 Act; or
(b) Knowingly files, or causes to be filed, with the commission
a greyhound injury report that contains incomplete, false or
misleading information.
(2) Failure to file a valid greyhound injury report is an
unclassified felony punishable by imprisonment for a period of
not more than two years, a fine of $2,500, or both. + }
SECTION 8. { + (1) A person commits the crime of aggravated
failure to file a valid greyhound injury report if the person:
(a) Commits an act described in section 7 of this 2003 Act; and
(b) Has previously been convicted under this section or section
7 of this 2003 Act.
(2) Aggravated failure to file a valid greyhound injury report
is an unclassified felony punishable by imprisonment for a period
of not more than five years, a fine of $5,000, or both. + }
