                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
 
  Establishes Oregon Commission on Land Use Reform. Specifies
membership. Directs commission to study strengths and weaknesses
of Oregon land use system and develop list of recommended
changes.  Requires commission to submit report to Legislative
Assembly, Governor and Land Conservation and Development
Commission not later than November 1, 2004.
  Sunsets December 31, 2004.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to Oregon Commission on Land Use Reform; and declaring
  an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1)(a) There is created the Oregon Commission
on Land Use Reform consisting of 11 members.
  (b) The President of the Senate shall appoint one member from
among members of the Senate.
  (c) The Speaker of the House of Representatives shall appoint
one member from among members of the House of Representatives.
  (d) The Governor shall appoint nine members as follows:
  (A) One member from the Land Conservation and Development
Commission;
  (B) One member representing the agriculture industry;
  (C) One member representing the timber industry;
  (D) One member representing the real estate or building
industry;
  (E) One member currently serving as a city elected official;
  (F) One member currently serving as a county commissioner or
county judge;
  (G) One member representing a metropolitan service district;
  (H) One member representing environmental protection interests;
and
  (I) One public member.
  (e) All members of the commission should be persons who are
knowledgeable about Oregon's land use system and who are familiar
with Oregon's economic and employment base.
 
  (2) The purpose of the commission is to study and make
recommendations on the existing policies and structures of the
Oregon land use system as they relate to the following issues:
  (a) The balance between the protection of resource lands and
the efficient expansion of urban growth boundaries;
  (b) The connection between the land use system and economic
development in urban areas and the farm and forest economy in
rural areas;
  (c) Efficient use of urban land;
  (d) Enforcement of local, regional and state land use laws; and
  (e) The legal and appeals processes applicable to land use
matters.
  (3) The commission shall:
  (a) Develop a report detailing the strengths and weaknesses of
Oregon's land use system with respect to the issues described in
subsection (2) of this section; and
  (b) Develop a list of recommended changes to the system that
address the identified strengths and weaknesses. The
recommendations shall identify those changes that require action
by the Legislative Assembly.
  (4) The commission is subject to the provisions of ORS 171.605
to 171.635 and has the authority contained in ORS 171.505 and
171.510.
  (5) The commission shall use the services of permanent
legislative staff to the greatest extent practicable.
  (6) All agencies of state government, as defined in ORS
174.111, are directed to assist the commission in the performance
of its duties and, to the extent permitted by laws relating to
confidentiality, to furnish such information and advice as the
members of the commission consider necessary to perform their
duties.
  (7) A majority of the members of the commission constitutes a
quorum for the transaction of business.
  (8) Official action by the commission requires the approval of
a majority of the members of the commission.
  (9) The commission shall elect one of its members to serve as
chairperson.
  (10) The commission shall submit its report, including
recommendations for legislation, to the Joint Legislative
Committee on Land Use established under ORS 197.125, to the
President of the Senate and to the Speaker of the House of
Representatives in the manner provided by ORS 192.245, no later
than November 1, 2004. The commission also shall provide a copy
of its report to the Governor and the Land Conservation and
Development Commission not later than November 1, 2004.
  (11) Members of the commission who are not members of the
Legislative Assembly are not entitled to compensation, but may be
reimbursed for actual and necessary travel and other expenses
incurred by them in the performance of their official duties, in
the manner and amounts provided for in ORS 292.495. Claims for
expenses shall be paid out of funds appropriated to the
Legislative Administration Committee for that purpose. + }
  SECTION 2.  { + Section 1 of this 2003 Act is repealed on
December 31, 2004. + }
  SECTION 3.  { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
