                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure.
 
  Allows lot, parcel or tract in exclusive farm use zone to be
divided into lots or parcels containing specified minimum number
of acres for siting dwellings if lot, parcel or tract to be
divided is contiguous to  { + or inside boundary of + } golf
course.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to dwellings in exclusive farm use zone; and declaring
  an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + (1) Notwithstanding ORS 215.203 (1), if any
part of a lot, parcel or tract located in an exclusive farm use
zone is contiguous to or inside the boundary of a golf course on
the effective date of this 2003 Act, the owner of the lot, parcel
or tract may:
  (a) Subdivide or partition the owner's land as provided under
ORS chapter 92 into lots or parcels containing a minimum of 2.5
acres to allow the establishment of a single-family dwelling on
each resulting lot or parcel; or
  (b) Subdivide or partition the owner's land as provided under
ORS chapter 92 into lots or parcels containing a minimum of five
acres to allow the establishment of a multifamily residential
structure on each resulting lot or parcel.
  (2) For purposes of subsection (1) of this section, land that
is 'contiguous' to the boundary of a golf course includes those
lots and parcels that are outside the boundary of the golf course
but share a common boundary with the golf course. A lot, parcel
or tract that is contiguous to but located outside the boundary
of the golf course may be developed under subsection (1) of this
section only to a distance of 2,000 feet from the boundary. A
lot, parcel or tract that is separated from the boundary of the
golf course by a road, river or stream is not 'contiguous' for
purposes of this section.
 
  (3) The provisions of this section are in addition to any other
lawful provision for establishing a dwelling in an exclusive farm
use zone.
  (4) A dwelling may not be established on a lot or parcel
created under subsection (1) of this section if the subdivided or
partitioned lot or parcel already contains a dwelling. + }
  SECTION 2.  { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
