                        A BILL FOR AN ACT
Relating to beverage containers.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Sections 2 and 3 of this 2003 Act are added to
and made a part of ORS 459A.700 to 459A.740. + }  { +  + }
  SECTION 2.  { + (1) A grocery store or food market shall keep
records of all beverage containers that are sold by the grocery
store or food market and records of all beverage containers that
are redeemed by the grocery store or food market. The records
shall be submitted to the Oregon Liquor Control Commission by
January 31, 2005, and shall include the number of beverage
containers sold and the number of beverage containers redeemed.
  (2) For purposes of this section and section 3 of this 2003
Act, 'grocery store or food market' has the meaning given that
term in ORS 616.850. + }
  SECTION 3.  { + The Oregon Liquor Control Commission shall
compile the records received under section 2 of this 2003 Act and
report the findings to the Legislative Assembly in the manner
provided in ORS 192.230 to 192.250. The report shall include:
  (1) The redemption rate of beverage containers;
  (2) The number of beverage containers redeemed by grocery
stores or food markets;
  (3) The dollar amount of deposits paid out by grocery stores or
food markets; and
  (4) The dollar amount representing an overredemption or
underredemption paid by grocery stores or food markets for
beverage containers. + }
  SECTION 4.  { + Sections 2 and 3 of this 2003 Act apply to
beverage containers sold or redeemed on or after the effective
date of this 2003 Act. + }
  SECTION 5.  { + The record submitting requirements in section 2
of this 2003 Act and the reporting requirements in section 3 of
this 2003 Act become operative on January 1, 2005. + }
  SECTION 6.  { + Sections 2 and 3 of this 2003 Act are repealed
on January 2, 2006. + }
