Permits left turn on steady red arrow signal under specified
conditions.
Creates offense of improper left turn at steady red arrow
signal. Punishes by maximum fine of $150.
A BILL FOR AN ACT
Relating to left turns.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2003 Act is added to and made
a part of ORS chapter 811. + }
SECTION 2. { + (1) A person operating a motorcycle who is
intending to turn left and is in a special left turn lane where
there is a traffic control device showing a steady red arrow
signal may, without violating ORS 811.265, make a left turn while
the traffic control device is showing a steady red arrow signal
if:
(a) A green left turn arrow signal on the traffic control
device is activated by the weight of the motorcycle on sensors in
the pavement; and
(b) The steady red arrow signal has not changed to a green left
turn arrow signal after two complete cycles of lights while the
motorcycle has been on the sensors.
(2) A person commits the offense of improper left turn at a
steady red arrow signal if the person does any of the following
while making a turn described in this section:
(a) Fails to exercise care to avoid an accident.
(b) Disobeys the directions of a traffic control device other
than a steady red arrow signal or a police officer that prohibits
the turn.
(c) Fails to yield the right of way to traffic lawfully within
the intersection or approaching so closely as to constitute an
immediate hazard.
(d) Fails to wait for two complete cycles of lights.
(3) A driver who is making a turn described in this section is
also subject to the requirements under ORS 811.045 to yield to
pedestrians while making the turn.
(4) The offense described in this section, improper left turn
at a steady red arrow signal, is a Class C traffic violation. + }
