  Creates exception to prohibition against giving hypodermic
devices to persons under 18 years of age.
 
                        A BILL FOR AN ACT
Relating to hypodermic devices; amending ORS 475.805.
Be It Enacted by the People of the State of Oregon:
  SECTION 1. ORS 475.805 is amended to read:
  475.805. (1)   { - No - }  { +  A + } person   { - shall - }
 { +  may not + } sell or give a hypodermic device to a minor
unless the minor { + :
  (a) + } Demonstrates a lawful need therefor by authorization of
a physician, parent or legal guardian or by other means
acceptable to the seller or donor { + ; or
  (b) Is at least 16 years of age and is a client of an
established needle exchange program and the person selling or
giving the hypodermic device is an employee of the program + }.
  (2) As used in this section { + : + }  { - , - }
   { +  (a) + } 'Hypodermic device' means a hypodermic needle or
syringe or medication packaged in a hypodermic syringe or any
instrument adapted for the subcutaneous injection of a controlled
substance as defined in ORS 475.005.
   { +  (b) 'Needle exchange program' means a program that
distributes clean hypodermic devices to a person in exchange for
a used hypodermic device and offers access to drug treatment,
counseling and other social services. + }
