  Authorizes partition of lot or parcel in exclusive farm use
zone when lot or parcel is divided by intervening lot or parcel
in separate ownership.
 
                        A BILL FOR AN ACT
Relating to land partitions.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2003 Act is added to and made
a part of ORS chapter 215. + }
  SECTION 2.  { + (1) Except as provided in subsection (3) of
this section, the governing body of a county or its designee may
approve an application to partition a lot or parcel located in an
exclusive farm use zone into two parcels provided:
  (a) The subject lot or parcel consists of two noncontiguous
pieces that are separated by an intervening lot or parcel in
different ownership; and
  (b) The intervening lot or parcel is not owned by a family
member of the owner of the subject lot or parcel.
  (2) For purposes of this section, 'family member' includes the
owner's wife, husband, son, daughter, mother, father, brother,
brother-in-law, sister, sister-in-law, son-in-law,
daughter-in-law, mother-in-law, father-in-law, aunt, uncle,
niece, nephew, stepparent, stepchild, grandparent or grandchild
or a business entity owned by any one or combination of these
family members.
  (3) The governing body or its designee may not approve an
application to partition under this section if the intervening
lot or parcel is a public or private roadway, another public
right of way or a railroad or utility right of way. + }
