Authorizes city to extend potable water supply or sanitary
sewer service to lots, parcels and tracts that are adjacent to
urban growth boundary of city.
A BILL FOR AN ACT
Relating to public facilities.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) A city may provide potable water supply and
sanitary sewer service to lots, parcels or tracts that are
adjacent to the urban growth boundary of the city without
adopting an exception under ORS 197.732 to a land use planning
goal relating to public facilities and services.
(2) The extension of potable water supply or sanitary sewer
service under this section to lots, parcels or tracts located
outside an urban growth boundary may not be a basis for or be
used to justify:
(a) Expansion of an urban growth boundary to include the lots,
parcels or tracts;
(b) Except as provided in this section, adoption of an
exception under ORS 197.732 to a land use planning goal for the
lots, parcels or tracts; or
(c) A zone change for the lots, parcels or tracts.
(3) As used in this section:
(a) 'Adjacent' means that a lot, parcel or tract is outside the
urban growth boundary of a city, but within ___ miles of the
boundary.
(b) 'Lot' and 'parcel' have the meaning given those terms in
ORS 92.010.
(c) 'Tract' has the meaning given that term in ORS 215.010.
(d) 'Urban growth boundary' has the meaning given that term in
ORS 197.295. + }
