                             SUMMARY

brief statement of the essential features of the measure.
 
  Defines development for purposes of land use planning goals
adopted to protect beaches and dunes.   { - Authorizes - }
 { + Prohibits + } Land Conservation and Development Commission
 { - to limit - }   { + from banning + } use of beachfront
protective structures to protect coastal development { +  that
occurred on or before January 1, 1977. Exempts ocean shore land
above 16 feet elevation from certain permit requirements + }.
 
                        A BILL FOR AN ACT
Relating to beachfront protective structures; creating new
  provisions; and amending ORS 390.760.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2003 Act is added to and made
a part of ORS chapter 197. + }
  SECTION 2.  { + (1) In adopting any goals under ORS 197.225 for
the protection of beaches and dunes, the Land Conservation and
Development Commission may not prohibit the use of beachfront
protective structures to protect coastal development that
occurred on or before January 1, 1977.
  (2) For purposes of this section and any goal adopted by the
commission for the protection of beaches and dunes, '
development' means houses, commercial and industrial buildings,
public and private streets, roads and highways, public and
private utility facilities, vacant lots that are physically
improved with streets and utilities, and any area where an
exception to a statewide planning goal protecting beaches and
dunes has been acknowledged. + }
  SECTION 3. ORS 390.760 is amended to read:
  390.760. ORS 390.640 does not apply to any
 { - state-owned - }  land
  { - or to headlands and other lands - }  located at an
elevation   { - of more than - }  { +  above + } 16 feet and
seaward of a line running between the following designated and
numbered points which are more particularly described by ORS
390.770. The elevation mentioned in this section refers to the
United States Coast and Geodetic Survey Sea-Level Datum of 1929
through the Pacific Northwest Supplementary Adjustment of 1947.
