SUMMARY
The following summary is not prepared by the sponsors of the

consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
Requires that Oregon Liquor Control Commission sell certain
distilled liquors at wholesale price except for reasonable markup
charges for warehousing, shipping and agent compensation when
those distilled liquors are sold through commission stores.
Applies only to first 10,000 gallons of distilled liquor produced
in Oregon by distillery licensee that produces less than 20,000
gallons of distilled liquor annually.
A BILL FOR AN ACT
Relating to alcoholic beverages.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + Section 2 of this 2003 Act is added to and made
a part of ORS chapter 471. + }
SECTION 2. { + (1) All retail sales by the Oregon Liquor
Control Commission of distilled liquor described in subsection
(3) of this section must be at the price paid to the manufacturer
except that the commission may by rule establish reasonable
charges for warehousing, shipping and agent compensation for
those distilled liquors that are sold through stores established
by the commission under ORS 471.750.
(2) A distillery licensee that has been appointed as a retail
sales agent of the commission under ORS 471.230 (2)(b) may sell
distilled liquor described in subsection (3) of this section that
has been distilled by the licensee in Oregon at such price as the
licensee may establish. Sales under this subsection may be made
on the licensed premises and at one other location, as allowed by
ORS 417.230 (2)(b).
(3) The provisions of this section apply only to the first
10,000 gallons of distilled liquor produced in Oregon by a
distillery licensee that produces less than 20,000 gallons of
distilled liquor annually. + }
