A BILL FOR AN ACT
Relating to death penalty; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) Notwithstanding ORS 163.105 and 163.150, a
person convicted of aggravated murder may not be sentenced to
death.
(2) Subsection (1) of this section applies to persons who are
charged with aggravated murder on or after the effective date of
this 2003 Act. + }
SECTION 2. { + Section 1 of this 2003 Act is repealed on
January 2, 2008. + }
SECTION 3. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
