SUMMARY
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.
Requires Governor to develop plan to create Department of
Public Safety with certain current agencies as divisions within
department. Requires Governor to prepare budget for department
for biennium beginning July 1, 2005. Requires Governor to report
to Emergency Board. Allows Governor to develop alternative plans.
A BILL FOR AN ACT
Relating to public safety.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) The Governor, in consultation with the
Oregon Criminal Justice Commission, shall develop a plan to
create a Department of Public Safety in which each of the
following becomes a separate division within the department that
reports directly to the Director of the Department of Public
Safety:
(a) The State Fire Marshal;
(b) The Department of Public Safety Standards and Training;
(c) The forensic laboratories established under ORS 181.080;
(d) The Department of State Police;
(e) The Department of Corrections;
(f) The Oregon Youth Authority;
(g) The Office of Emergency Management;
(h) The State Board of Parole and Post-Prison Supervision;
(i) The Psychiatric Security Review Board; and
(j) Information technology, including but not limited to the
Law Enforcement Data System.
(2) In creating the Department of Public Safety, the Governor
shall:
(a) Consolidate common functions, including but not limited to
information technology, personnel functions and criminal
background checks;
(b) Ensure that a centralized process for evaluating department
programs and collecting data necessary for such evaluations is
included in the department organization; and
(c) Consider utilizing the resources of the Oregon Criminal
Justice Commission to provide ongoing assistance to the director
of the department.
(3) The Governor shall cause legislation to be drafted to carry
out the creation of the department.
(4) The Governor shall prepare a budget for the department for
the biennium beginning July 1, 2005.
(5) The Governor shall report on the progress of the plan to
the Emergency Board at the first meeting of the board held after
June 30, 2004.
(6) The Governor shall present the final plan, including
legislation and a budget, to the Emergency Board at the first
meeting of the board held after November 30, 2004.
(7) In addition to the plan required by subsection (1) of this
section, the Governor may develop and present alternative plans
for the creation of a Department of Public Safety. + }
