                             SUMMARY
 
The following summary is not prepared by the sponsors of the
measure and is not a part of the body thereof subject to
consideration by the Legislative Assembly. It is an editor's
brief statement of the essential features of the measure as
introduced.
 
  Directs Quality Education Commission to establish maximum
average number of kindergarten through grade 5 students per
class.  Directs commission to establish minimum number of school
days each year for which school district must offer instructional
services.  Specifies maximum average number of students and
minimum number of days to be implemented by school districts
prior to commission's adoption of requirements.
 
                        A BILL FOR AN ACT
Relating to education; creating new provisions; and amending ORS
  327.506.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Each school district shall adopt a policy that
establishes a maximum number of students:
  (1) For the 2005-2006 school year, so that the average number
of students in each kindergarten through grade 3 class does not
exceed 20 students; and
  (2) For the 2006-2007 school year, so that the average number
of students in each grade 4 and grade 5 class does not exceed 24
students. + }
  SECTION 2.  { + Each school district shall adopt a policy that
establishes a maximum number of students per class so that the
average number of students in each kindergarten through grade 5
class does not exceed the maximum number of students per class
required by the Quality Education Commission for that grade under
ORS 327.506. + }
  SECTION 3.  { + Section 2 of this 2003 Act first applies to:
  (1) The 2006-2007 school year for each kindergarten through
grade 3 class; and
  (2) The 2007-2008 school year for each grade 4 and grade 5
class. + }
  SECTION 4.  { + Each school district shall adopt a policy that
establishes the minimum number of school days in each school year
for which the school district will offer instructional services
to students. The number of school days adopted by a district may
not be less than the minimum number of school days required by
the Quality Education Commission under ORS 327.506. + }
 
  SECTION 5.  { + Section 4 of this 2003 Act first applies to the
2005-2006 school year. + }
  SECTION 6. ORS 327.506 is amended to read:
  327.506. (1) The quality goals for the state's system of
kindergarten through grade 12 public education include those
established under ORS 329.007, 329.015, 329.025, 329.035,
329.045, 329.065, 329.465, 329.475 and 329.487.
  (2) Each biennium the Quality Education Commission shall
determine the amount of moneys sufficient to ensure that the
state's system of kindergarten through grade 12 public education
meets the quality goals.
  (3) In determining the amount of moneys sufficient to meet the
quality goals, the commission shall identify best practices that
lead to high student performance and the costs of implementing
those best practices in the state's kindergarten through grade 12
public schools. Those best practices shall be based on research,
data, professional judgment and public values.
  (4) Prior to August 1 of each even-numbered year, the
commission shall issue a report to the Governor and the
Legislative Assembly that identifies:
  (a) Current practices in the state's system of kindergarten
through grade 12 public education, the costs of continuing those
practices and the expected student performance under those
practices; and
  (b) The best practices for meeting the quality goals, the costs
of implementing the best practices and the expected student
performance under the best practices.
  (5) In addition, the commission shall provide in the report
issued under subsection (4) of this section at least two
alternatives for meeting the quality goals. The alternatives may
use different approaches for meeting the quality goals or use a
phased implementation of best practices for meeting the quality
goals.
   { +  (6) The commission shall include in the best practices
required to be identified under subsection (3) of this section
the average maximum number of students required for each
kindergarten through grade 5 class and the minimum number of
school days in each school year for which each school district is
required to offer instructional services to students. + }
  SECTION 7.  { + (1) The requirement adopted by the Quality
Education Commission under ORS 327.503 (6) that identifies the
average maximum number of students per class first applies to:
  (a) The 2006-2007 school year for each kindergarten through
grade 3 class; and
  (b) The 2007-2008 school year for each grade 4 and grade 5
class.
  (2) The requirement adopted by the commission under ORS 327.503
(6) that identifies the minimum number of school days that a
school district is required to offer instructional services to
students first applies to the 2005-2006 school year. + }
