                    B-ENGROSSED SENATE BILL 5

                         Amended Summary
  Authorizes Director of Oregon Department of Administrative
Services, with approval of State Treasurer, to enter into
agreements to grant incremental baseball tax revenues for period
of not more than 30 years. Specifies provisions of grants. Limits
state liability.
  Establishes Major League Stadium Grant Fund.  { + Prohibits
transfer of moneys to fund until July 1, 2005. + }
  Specifies rate of withholding on income of member of
professional athletic team.
  Limits biennial expenditures of Oregon Department of
Administrative Services for payment of grant to fund construction
of stadium.
  Takes effect on 91st day following adjournment sine die.
 
President Courtney:
  Your Conference Committee to whom was referred B-engrossed
Senate Bill 5, having had the same under consideration,
respectfully reports it back with the recommendation that the
Senate concur in the House amendments dated August 12 and that
the bill be amended as follows and repassed.
 
  On page 1 of the printed B-engrossed bill, line 9, delete '
without regard to filing status' and insert 'including revenues
that are generated from the tax liabilities of spouses of members
of a professional athletic team engaged in Major League Baseball
if the tax liabilities are reported on a joint return'.
  In line 13, after 'liabilities' delete the rest of the line and
line 14.
  In line 15, delete 'to filing status,' and insert ', as
described in subparagraph (A) of this paragraph, that would have
been due'.
  On page 2, line 2, after 'means' delete the rest of the line
and lines 3 through 5 and insert 'the tax determined under ORS
chapter 316 for the tax year less the credits allowed for
purposes of ORS chapter 316 for the tax year.
  ' (2) The Department of Revenue may adopt administrative rules
that the department determines are necessary to:
  ' (a) Further define the terms defined in this section in a
manner consistent with this section;
  ' (b) Implement the duties of the department under sections 1
to 4 of this 2003 Act; and
  ' (c) Carry out the purposes of sections 1 to 4 of this 2003
Act.'.
  On page 3, delete line 12 and insert:
  ' (L) Provide assurances of full and fair participation in the
construction, furnishing and operation of the major league
stadium by women, minorities and small businesses;
 
  ' (m) Provide for the maximization of economic benefits for
Oregon workers in the construction, furnishing and operation of
the major league stadium to the greatest extent permitted by law;
and'.
  In line 13, delete '(L)' and insert '(n)'.
  On page 4, after line 15, insert:
  ' (4) No grantee is both a public body and a guarantor for the
repayment of bonds or other indebtedness that is to be repaid
through use of grant moneys;'.
  In line 16, delete '(4)' and insert '(5)'.
  In line 18, delete '(5)' and insert '(6)'.
  In line 26, delete '(5)' and insert '(6)'.
  In line 29, delete '(4)' and insert '(5)'.
  On page 5, line 21, delete 'an alter-'.
  In line 22, delete 'native formula' and insert ' alternative
methodologies'.
  Delete lines 39 through 45.
  On page 6, delete line 1 and insert:
  '  { +  SECTION 8a. + }  { + (1) The Department of Revenue may
adopt administrative rules the department determines are
necessary to:
  ' (a) Implement the duties of the department under sections 6
to 8a of this 2003 Act; and
  ' (b) Carry out the purposes of sections 6 to 8a of this 2003
Act.
  ' (2) The rules may include, but are not limited to:
  ' (a) Rules providing alternative methodologies for determining
the portion of compensation subject to withholding under section
7 (4) of this 2003 Act that the department determines to be fair
and equitable; and
  ' (b) Rules construing ORS 316.162 to 316.212 in a manner that
is consistent and compatible with the withholding provisions of
sections 6 to 8a of this 2003 Act. + } ' .
  After line 12, insert:
  '  { +  SECTION 11. + }  { + Notwithstanding any other
provision of law, a transfer or deposit into the Major League
Stadium Grant Fund established under section 4 of this 2003 Act
may not be made prior to July 1, 2005. + } ' .
  In line 13, delete '11' and insert '12'.
