Limits number of students served by one school.
A BILL FOR AN ACT
Relating to school size.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) For purposes of this section, 'school'
means a group of students and teachers who remain together for
all of the regular school program, as defined in ORS 339.141. The
program may be in the same school building as other programs.
(2) A school district may not operate:
(a) A kindergarten through grade 5 school that serves more than
400 students.
(b) A grade 6 through grade 8 school that serves more than 500
students.
(c) A grade 9 through grade 12 school that serves more than 800
students.
(3) A school district may submit a request to the State Board
of Education for a waiver of the maximum school size requirements
of subsection (2) of this section. Upon receipt of a request for
a waiver, the board shall grant the waiver if the board
determines that the school district has demonstrated compelling
reasons for not meeting the maximum school size requirements. The
board may grant a waiver under this subsection only for a
specified period of time.
(4) The State Board of Education may adopt any rules necessary
to implement this section. + }

July 1, 2004. + }
