brief statement of the essential features of the measure as
introduced.
 
  Directs Oregon Department of Administrative Services to
establish prescription drug bulk purchasing program.
 
                        A BILL FOR AN ACT
Relating to bulk purchasing of prescription drugs; and
  appropriating money.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + As used in section 2 of this 2003 Act:
  (1) 'Prescription drug' has the meaning given that term in ORS
689.005.
  (2) 'Supplier' means a manufacturer as defined in ORS 689.005
or a corporation, individual or other entity that buys drugs for
resale and distributes the drugs to corporations, individuals or
entities other than consumers. + }
  SECTION 2.  { + (1) There is established in the Oregon
Department of Administrative Services the prescription drug bulk
purchasing program. The purpose of the program is to receive a
discounted price by purchasing prescription drugs in bulk from
suppliers for state or other governmental agencies.
  (2) The Director of the Oregon Department of Administrative
Services shall appoint an administrator of the prescription drug
bulk purchasing program or contract with a prescription benefits
manager to administer the program.
  (3) The administrator or manager of the prescription drug bulk
purchasing program shall:
  (a) Negotiate price discounts on prescription drugs with
prescription drug suppliers;
  (b) Purchase prescription drugs for all state agencies that
provide prescription drugs;
  (c) Work with pharmacies to make the negotiated prices
available to any person who does not have prescription drug
coverage; and
  (d) Establish a system for distributing the prescription drugs
purchased by the program.
  (4) The administrator or manager may also purchase and
distribute prescription drugs for the following groups:
  (a) Enrollees in the Medicare program who do not have
prescription drug coverage;
  (b) Persons who purchase or receive health care services
through the health benefits program of the Public Employees'
Benefit Board;
  (c) Any other individuals on whose behalf the state funds or
subsidizes, in whole or in part, the purchase of prescription
drugs or prescription drug coverage; and
  (d) Residents of Oregon with limited or no insurance coverage
for prescription drugs.
  (5) Upon request, the department may include other governmental
entities in the prescription drug bulk purchasing program. + }
  SECTION 3.  { + The Oregon Department of Administrative
Services shall adopt rules to implement sections 1 and 2 of this
2003 Act. + }
  SECTION 4.  { + Sections 1 to 3 of this 2003 Act become
operative on July 1, 2004. + }
  SECTION 5.  { + There is appropriated to the Oregon Department
of Administrative Services, for the biennium beginning July 1,
2003, out of the General Fund, the amount of $___ for the purpose
of carrying out sections 1 to 3 of this 2003 Act. + }
