brief statement of the essential features of the measure as
introduced.
 
  Prohibits state government and school districts from executing
collective bargaining agreements before funds are appropriated
for biennium that encompasses duration of agreement.
  Declares emergency, effective on passage.
 
                        A BILL FOR AN ACT
Relating to public employee collective bargaining agreements; and
  declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2003 Act is added to and made
a part of ORS 243.650 to 243.782. + }
  SECTION 2.  { + (1) As used in this section:
  (a) 'School district' has the meaning given that term in ORS
332.002; and
  (b) 'State government' has the meaning given that term in ORS
174.111.
  (2) State government may not execute a collective bargaining
agreement with the exclusive representative of an appropriate
bargaining unit of state government employees before the
Legislative Assembly has appropriated funds to state government
for the biennium that encompasses the duration of the agreement.
  (3) A school district may not execute a collective bargaining
agreement with the exclusive representative of an appropriate
bargaining unit of school district employees before the
Legislative Assembly has appropriated funds to the Department of
Education for the State School Fund for the biennium that
encompasses the duration of the agreement. + }
  SECTION 3.  { + Section 2 of this 2003 Act does not apply to
collective bargaining agreements entered into before the
effective date of this 2003 Act. + }
  SECTION 4.  { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on
passage. + }
