SUMMARY

Directs Oregon Criminal Justice Commission to classify
manslaughter in second degree and criminally negligent homicide
as crime category 9 { + if resulting from operation of motor
vehicle while under influence of intoxicants. Increases
punishment for criminally negligent homicide + }.
A BILL FOR AN ACT
Relating to sentencing guidelines; creating new provisions; and
amending ORS 163.145.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + The Oregon Criminal Justice Commission shall
classify manslaughter in the second degree as described in ORS
163.125 and criminally negligent homicide as described in ORS
163.145 as crime category 9 of the sentencing guidelines grid of
the commission if:
(1) The manslaughter or criminally negligent homicide resulted
from the operation of a motor vehicle; and
(2) The driver of the motor vehicle was driving while under the
influence of intoxicants. + }
SECTION 2. ORS 163.145 is amended to read:
163.145. (1) A person commits the crime of criminally negligent
homicide when, with criminal negligence, the person causes the
death of another person.
(2) Criminally negligent homicide is a { - Class C - }
{ + Class B + } felony.
