                      SENATE AMENDMENTS TO

  On page 1 of the printed bill, line 2, delete '183.315,'.
  In line 3, delete '291.045,' and delete '351.203,'.
  Delete lines 21 through 25 and insert:
  '  { +  SECTION 1. + } ORS 348.603 is amended to read:
  ' 348.603. (1) The Oregon Student Assistance Commission,
through the Office of Degree Authorization, shall:
  ' (a) Authorize approved schools to offer academic degree
programs;
  ' (b) Authorize approved degree-granting schools to offer
nondegree programs leading to a certificate or diploma;
  ' (c) Validate claims of degree possession;
  ' (d) Terminate substandard or fraudulent degree activities;
and
  ' (e) Review proposed new publicly funded post-secondary
programs and locations.
  ' (2)(a) Following review of a proposed new publicly funded
post-secondary program or location, the commission shall
recommend resolution to the appropriate governing boards and
mediate between the boards to seek a negotiated resolution if:
  ' (A) There is a   { - seemingly - }  detrimental duplication
of programs; or
  ' (B) The program or location would have a significantly
adverse impact on one or more other segments of education.
  ' (b) If the boards   { - cannot - }   { + do not + } resolve
the issue raised under paragraph (a) of this subsection
 { - , - }   { + within 90 days of the date when the issue was
recommended to the boards for mediation, + } the commission shall
have final authority for approval or disapproval of the program
or location.  { + If the boards do not resolve the issue, the
commission shall approve or disapprove the program or location
within 180 days of the date when the review began.
  ' (c) If the boards do not resolve the issue, the commission
shall approve the program or location if the commission finds
that the program or location meets an unmet workforce need in the
state. + }
  '  { - (c) - }  { +  (d) + } The commission shall establish by
rule a fair and neutral decision-making process in consultation
with representatives designated by the State Board of Education,
the State Board of Higher Education, associations representing
Oregon independent colleges, associations representing Oregon
career colleges, and the governing boards of otherwise
unrepresented post-secondary schools.'.

  On page 3, line 5, after the period delete the rest of the line
and lines 6 through 9.
  On page 5, delete line 2.
  In line 3, delete '(c)' and insert '(b)'.
  In line 4, delete '(d)' and insert '(c)' and after the
semicolon insert 'and'.
 
  In line 5, delete '(e)' and insert '(d)' and delete '; and' and
insert a period.
  Delete line 6.
  Delete lines 11 through 26 and insert:
  '  { +  SECTION 5. + } ORS 351.094 is amended to read:
  ' 351.094. (1) { + (a) + } Notwithstanding any other provision
of law, the Oregon University System shall provide group
insurance to its employees through the Public Employees' Benefit
Board, but may elect, at the discretion of the State Board of
Higher Education, to provide alternative benefit plans to its
employees  { - , should - }  { + .
  ' (b) Notwithstanding paragraph (a) of this subsection, the
State Board of Higher Education may elect to provide alternative
benefit plans to its classified employees only if + } the same
level of benefits   { - be - }  { +  is + } available at a lower
cost than  { + benefit plans provided + } through the Public
Employees' Benefit Board.
  ' (2) For the purposes of ORS 243.555 to 243.575, if the State
Board of Higher Education chooses not to participate in the
benefit plans offered through the Public Employees' Benefit
Board, the State Board of Higher Education may have the authority
granted to the Public Employees' Benefit Board under ORS 243.555
to 243.575 for the administration of an appropriate expense
reimbursement plan.
  ' (3) The Oregon University System shall offer a deferred
compensation plan for its employees. The Oregon University System
shall, at the discretion of the board, choose whether to offer
its employees the state deferred compensation plan established
under ORS 243.401 to 243.507 or another deferred compensation
plan that the board elects to make available to the employees of
the Oregon University System.'.
  Delete lines 30 through 39 and insert:

Subsequent sections were not renumbered.'.
  On page 10, after line 44, insert:
  ' (2) There is established within the Higher Education Student
Tuition and Fees Revolving Fund an account to be known as the
Tuition Payment Account. All moneys received by the department
from tuition payments shall be deposited in the account.'.
  In line 45, delete '(2)' and insert '(3)'.
  On page 11, delete lines 2 through 27.
  In line 28, delete '28' and insert '27'.
  On page 14, line 33, delete '29' and insert '28'.
  On page 15, line 3, delete '(4)' and insert '(4)(a)'.
  After line 5, insert:
  ' (b) Notwithstanding paragraph (a) of this subsection, the
Public Employees' Benefit Board may terminate the participation
of the Oregon University System in a benefit plan for classified
employees only if the alternative benefit plan meets the
requirements of ORS 351.094 (1)(b).'.
  In line 6, delete '30' and insert '29'.
  On page 17, delete lines 26 through 42.
  In line 43, delete '32' and insert '30'.
  In line 44, delete '33' and insert '31'.
