SUMMARY

Requires law enforcement agency to adopt written policy
concerning safe storage of employees' service weapons.
A BILL FOR AN ACT
Relating to law enforcement agencies.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) As used in this section and section 2 of
this 2003 Act, 'law enforcement agency' means any agency that
employs public safety personnel as described in ORS 181.610 who
are issued service weapons.
(2) A law enforcement agency shall adopt a written policy
concerning the safe storage of its employees' service weapons.
The purpose of the policy is to ensure that a service weapon is:
(a) Inaccessible to children or persons who are prohibited from
possessing weapons; or
(b) Inoperable when the weapon is not in the immediate
possession of the employee.
(3) In adopting a policy under this section, a law enforcement
agency may consider requiring the use of trigger locks, gun safes
or any other mechanism designed to render a weapon inoperable or
inaccessible.
(4) A law enforcement agency shall make the policy adopted
under this section available to the public.
(5) Violation of a policy adopted under this section is grounds
for disciplinary action. + }
SECTION 2. { + (1) No later than July 1, 2004, a law
enforcement agency shall adopt a policy required by section 1 of
this 2003 Act.
(2) No later than August 1, 2004, a law enforcement agency
shall submit the policy required by section 1 of this 2003 Act to
the Oregon Criminal Justice Commission.
(3) No later than December 31, 2004, the commission shall
submit a report to the Legislative Assembly containing a summary
of the policies submitted to the commission pursuant to this
section. + }
SECTION 3. { + Unless otherwise authorized by the employment
contract of the employee, section 1 (5) of this 2003 Act does not
apply to contracts entered into before the effective date of this
2003 Act. + }
