                             SUMMARY

brief statement of the essential features of the measure.
 
  Creates Community College State Funding Commission to study and
recommend state funding levels for community colleges.
  Declares emergency, effective July 1, 2003.
 
                        A BILL FOR AN ACT
Relating to community colleges; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Sections 2 and 3 of this 2003 Act are added to
and made a part of ORS chapter 341. + }
  SECTION 2.  { + (1) There is created in the Office of the
Governor the Community College State Funding Commission to study
the funding needs of community college districts and community
college service districts and to determine an adequate level of
state funding for community college districts and community
college service districts.
  (2) The commission shall consist of 10 members and shall elect
one of its members to serve as chairperson.
  (3) The Commissioner for Community College Services, or the
commissioner's designee, shall serve as a member.
  (4) The Governor shall appoint:
  (a) One member of the public who represents a statewide
business association;
  (b) One member of the public who represents a key industry;
  (c) One member who may be selected from individuals recommended
by the Oregon Community College Association and who is a member
of a community college district board or a community college
service district board in this state that represents a community
college with less than 6,000 full-time equivalent students;
  (d) One member who may be selected from individuals recommended
by the Oregon Community College Association and who is a member
of a community college district board or a community college
service district board in this state that represents a community
college of any size; and
  (e) One member who may be selected from individuals recommended
by the Oregon Community College Association and who is a
community college president.
  (5) The Speaker of the House of Representatives shall appoint
one member of the House of Representatives who is a member of the
Republican party and one member of the House of Representatives
who is a member of the Democratic party.
  (6) The President of the Senate shall appoint one member of the
Senate who is a member of the Republican party and one member of
the Senate who is a member of the Democratic party.
  (7) The term of office of each legislative member is two years
and the term of office of each nonlegislative member is four
years. Each member serves at the pleasure of the appointing
authority. Before the expiration of the term of a member, the
appointing authority shall appoint a successor. A member is
eligible for reappointment. If there is a vacancy for any cause,
the appointing authority shall make an appointment to become
immediately effective for the unexpired term.
  (8) The commission shall study and make recommendations on the
appropriate level of state funding for community college
districts and community college service districts in this state.
  (9) The commission shall report to the Governor and the
legislative interim committees on revenue in the manner provided
in ORS 192.245 no later than October 1 of each even-numbered
year.  The report shall include recommendations as described in
subsection (8) of this section and may include recommendations
for other legislation.
  (10) A member of the commission who is not a member of the
Legislative Assembly is entitled to compensation and expenses in
the manner and amounts as provided in ORS 292.495. Claims for
compensation and expenses incurred in performing the functions of
the commission shall be paid out of funds appropriated to the
Office of the Governor. A member of the commission who is a
member of the Legislative Assembly is entitled to compensation
and expenses as provided in ORS 171.072 from funds appropriated
to the Legislative Assembly for such purposes.
  (11) A majority of the members of the commission constitutes a
quorum for the transaction of business.
  (12) The Department of Community Colleges and Workforce
Development shall provide staff to the commission. Upon request
from the commission, the Department of Revenue shall provide
technical assistance to the commission. + }
  SECTION 3.  { + Notwithstanding the term of office specified by
section 2 of this 2003 Act, of the members first appointed to the
Community College State Funding Commission under section 2 (4) of
this 2003 Act:
  (1) One shall serve for a term ending July 1, 2004.
  (2) One shall serve for a term ending July 1, 2005.
  (3) One shall serve for a term ending July 1, 2006.
  (4) Two shall serve for terms ending July 1, 2007. + }
  SECTION 4.  { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect July 1,
2003. + }
