SUMMARY

Requires public school personnel to send letter to parent or
guardian of student to recommend evaluation by licensed physician
if school personnel perceives behavioral or psychological
problem.
Prohibits public school personnel from recommending to parent
or guardian that student seek prescription for certain types of
medication.
Declares emergency, effective on passage.
A BILL FOR AN ACT
Relating to students; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) A kindergarten through grade 12 public
school administrator, teacher, counselor or nurse who perceives
that a student has a behavioral or psychological problem shall
send a letter to the parent or legal guardian of the student to
recommend that a licensed physician conduct an appropriate
medical or behavioral health evaluation of the student.
(2) A kindergarten through grade 12 public school
administrator, teacher, counselor or nurse may not recommend to a
parent or legal guardian of a student, by a letter required under
subsection (1) of this section or otherwise, that the student
seek a prescription for a medication that is prescribed with the
intent of affecting or altering the thought processes, mood or
behavior of the student. + }
SECTION 2. { + Section 1 of this 2003 Act first applies to the
2003-2004 school year. + }
SECTION 3. { + This 2003 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2003 Act takes effect on its
passage. + }
