SUMMARY
The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.
Creates crimes of unlawful use of theft detection shielding
device and unlawful use of theft detection device deactivator or
remover. Punishes by maximum of six months' imprisonment, $2,000
fine, or both.
A BILL FOR AN ACT
Relating to theft detection.
Be It Enacted by the People of the State of Oregon:
SECTION 1. { + (1) A person commits the crime of unlawful use
of a theft detection shielding device when:
(a) The person possesses a device that is intended to shield
merchandise from detection by an electronic or magnetic theft
detector and the person intends to commit or assist in committing
theft; or
(b) The person manufactures, sells, offers for sale or
distributes a device intended to shield merchandise from
detection by an electronic or magnetic theft detector.
(2) Unlawful use of a theft detection shielding device is a
Class B misdemeanor. + }
SECTION 2. { + (1) A person commits the crime of unlawful use
of a theft detection device deactivator or remover when the
person intends to commit or assist in committing theft and the
person:
(a) Possesses a tool or device that is designed to or that is
capable of deactivating or removing a theft detection device from
merchandise;
(b) Manufactures, sells, offers for sale or distributes a tool
or device that is designed to or that is capable of deactivating
or removing a theft detection device from merchandise; or
(c) Deactivates a theft detection device on or removes a theft
detection device from merchandise.
(2) Unlawful use of a theft detection device deactivator or
remover is a Class B misdemeanor. + }
