  On page 1 of the printed bill, line 4, delete '11' and insert
'8'.
  In line 6, delete '11' and insert '8'.
  Delete lines 12 through 16 and insert:
  ' (2) 'Contractor' means a public employer or private employer
that:
  ' (a) Receives state funds for supplying services under a
written contract with a public body; and
  ' (b)(A) In the previous calendar year received at least 50
percent of the employer's business income that is apportioned to
this state under ORS 314.605 to 314.675 from state funds; or
  ' (B) If the employer is exempt from income tax under section
501(a) of the Internal Revenue Code, in the previous calendar
year received at least 50 percent of the employer's total revenue
from state funds.'.
  In line 17, delete '(4)' and insert '(3)'.
  In line 19, delete '(5)' and insert '(4)'.
  In line 20, delete '(6)' and insert '(5)'.
  In line 22, delete '(7)' and insert '(6)'.
  Delete lines 26 through 30.
  On page 2, line 1, delete '4' and insert '3'.
  In line 4, after 'contracts' insert 'for services'.
  In line 5, before the period insert 'and require the contractor
to make the contractor's records available at reasonable times
and places to the public body to determine whether the contractor
is complying with subsection (1) of this section'.
  Delete lines 9 through 12.
  In line 13, delete '(5)' and insert '(4)'.
  In line 15, delete '5' and insert '4'.
  Delete lines 26 through 29 and insert:
  ' (4) All grants of state funds shall require that the
recipient of the grant of state funds make the recipient's
records available at reasonable times and places to the grantor
to determine whether the recipient is complying with this
section.'.
  Delete lines 33 through 40.
  In line 41, delete '7' and insert '5'.
  On page 3, delete lines 1 through 14.
  In line 15, delete '9' and insert '6'.
  In line 16, delete 'sections 3 to 8' and insert 'section 3, 4
or 5'.
  Delete lines 25 through 27 and insert:
  ' (4) The court may award costs and attorney fees to:
  ' (a) The Attorney General or a taxpayer when the Attorney
General or the taxpayer prevails in an action brought under this
section.
  ' (b) A prevailing intervenor taxpayer who makes a substantial
contribution to an action brought under this section.
 
 
  ' (c) A prevailing contractor, public employer or recipient of
a grant of state funds if the court finds that the action under
this section was brought in bad faith.'.
  In line 28, delete '10' and insert '7' and delete '11 ' and
insert '8'.
  In line 36, delete '11' and insert '8' in both places.
  On page 4, line 1, delete '12' and insert '9' and delete ' 11'
and insert '8'.
